A Texas father-son duo are charged with murder after a dispute with a neighbor over a mattress turned deadly, shocking video shot by the deceased man’s wife appears to show. Warning – Graphic Footage: Viewer discretion strongly advised
In video of the Sept. 1 incident released Wednesday, Kara Box captured her husband Aaron Howard arguing over trash in their Abilene alleyway with next-door neighbors John Miller, 67, and his son Michael Miller, 31. “We had thrown out a twin mattress in a dumpster in our alley a few days before the shooting,” Box commented on the video, according to The Star-Telegram. “You have to have the mattress in the dumpster or they will not haul it away.”
Box says the Millers grabbed the mattress out of the dumpster and threw it on Howard’s property, sparking a shouting match between the neighbors. “Michael Miller who lives with his father ran went inside their home and got a shotgun,” The Telegram wrote in a Sept. 2 article following the incident. “Someone went into Howard’s home and retrieved a baseball bat.” The showdown ended with Howard shot after he stepped forward following a threat from Miller, who warned, “If you come within 3 feet of me, I’m going to kill you.” The Millers were arrested later that day. The Telegram reports they have since posted a $25,000 bail.

These two put themselves in horrible legal jeopardy. If you already have a gun and someone is threatening you; if you leave and come back with a gun, you no longer can claim you were standing your ground. You also can be thought of as having shown intent.
The best move for those two was, when back at the house, would have been to retrieve the firearms and made ready (just in case), and then to have sat down and popped a beer.
Sounds like neighbors who deserved each other. But never bring a baseball bat to a gunfight. From the story it sounds like the shotgun got there first.
My neighbors aren’t particularly friendly, but I could do a lot worse.

If I read correctly, the father was armed when he went outside, but the son is the one who returned to the house to retrieve a shotgun.
I find it very curious that the two men got out on such a nominal amount of bail. Perhaps there is more history to this than the paper lets on.
These people do no represent “the united states”.

Ok, well, that changes things a little... HOWEVER I still feel that there was a duty to retreat. I would have left, then called the police about the death threats Orange Shirt was making. Get the cop to retrieve Wifey’s phone.
I’m fine if they hang them, but nothing will happen. In China they would have a quick trial and get a bullet to the back of the head.
