Leo Varadkar was branded an “airhead” today as Downing Street dismissed his extraordinary threat to “ban” British aircraft from Irish airspace in the event of a no-deal Brexit.

The Irish PM was slapped down by Theresa May’s spokeswoman over the saber-rattling — which is being seen as tit-for-tat for the UK reclaiming control over its territorial waters.

As the row raged, Mrs. May urged the EU to take a more “practical” approach to the negotiations — insisting her Chequers plan offered a “comprehensive” solution to the need to avoid a hard Irish border.

And No. 10 gave short shrift to the threat from Mr. Varadkar, making clear he had misunderstood the legal position. […]

Brexiteers were even blunter, accusing Mr. Varadkar of being an “airhead” and making himself look ridiculous.

If British planes were banned from Irish airspace, it could block the UK’s main route to the US. Critics have also pointed out the vast majority of planes leaving Ireland fly over the UK — leaving limited options from Dublin if the two countries blocked each other’s airspace. …

Why can’t he ban them?! Ireland, well most of it is independent of England. Might not be able to enforce, but it is their airspace.

Not when they are signatories of treaties that define international air travel like the Warsaw Convention of 1929, the Chicago Convention of 1944, the 1955 Hague amendments to the Warsaw Convention, the 1971 Guatemala, City revisions of the Warsaw Convention, and the 1999 Montreal Convention.

The First Freedom of the Air is to overfly a country without landing in it. There are lots of overflights of countries all over the world. Even when the US did not recognize the Cuban government, flights between Canada and Cuba overflew the US just about every day.
