2016: If Hillary Is Indicted, President Clinton Could Pardon Herself and Congress Might be Helpless

On Friday, just days before the election, reports are emerging that the FBI has re-opened the Hillary Clinton email investigation. “The FBI has learned of the existence of emails that appear to be pertinent to the investigation,” a letter from FBI Director James Comey reads. And while Comey didn’t indicate how long the investigation could take, it’s pretty safe to bet investigators won’t come to any kind of decision before November 8th. It may even take months for the FBI to wrap up round two of this. So what happens if Clinton is elected, takes office, and then finds her self under indictment? It might not be likely, but it is worth exploring the legal possibilities.

The House:

Acts as a grand jury. If she has committed crimes, she can pardon herself civilly, but she cannot avoid impeachment. The House runs an investigation. If the House makes a criminal referral to the Senate, she stands trial there.

The U. S. Senate:

This is the court proceeding. They evaluate the evidence and vote on whether she has guilty of what the House referred to them.

If they vote that she was guilty, she is removed from office.

Civil Exposure to Prosecution:

I don’t think she can be tried civilly on the matters she has pardoned herself for, but if they have more charges to bring that she didn’t pardon herself for, the game is afoot.

Correct me if I’m wrong but:

1. You cannot indict a setting President. Not Trump. Not Hillary. Long term Justice Policy and, IMHO, the Constitution.

2. The President can pardon anyone who has been indicted or convicted of a crime.

3. The President cannot be indicted so the question of pardoning himself can never come up.

Oh, I don't know. Maybe because the Media is having convulsions because Giuliani said Trump could Pardon himself when he was being interviewed by Steffie on ABC yesterday?

are most pardons expressed as forgiving all crimes before the date of the pardon?

and if that is the case, having charges not brought up for trial would be moot, lest they occurred after the issuance of the said pardon.

I believe you have to name the issue the pardon is for.

I don’t think you can just say, “You are hereby pardoned for anything you may have ever done in your life.”

With Hillary, the reading of a self-pardon would be a very delicious thing. We could read exactly what it is she thinks she needed to be pardoned for.

LOL, that would be a hoot.

So what happens if Clinton is elected, takes office, and then finds her self under indictment?
