Actually, the judge meant to say that the law is based on sex discrimination, not gender discrimination which I do not think gender discrimination is either illegal or unconstitutional.

If you don't like masculine words you are free to remove them from your vocabulary and use only words of the feminine or neuter persuasion. It will limit your ability to communicate, but it is not illegal.

I’m not disagreeing with your analysis. But basically the judge said they can go ahead and be topless in public.

I'm not sure when it began but "gender" has been substituted for "sex" for a long time so much so that it is now in the dictionary. I suspect "gender" got its start when HR departments and others reviewing applications got tired of reading "twice a week" next to "sex".

Back in the 70s the Air Force handed out to everyone a great guide to writing named "The Tongue & Quill." It was a guide to writing and making speeches/presentations and stressed using the active voice and to be precise with words; no fat, no verbosity. The Air Force and our leaders actually expected us to be short and to the point and we were told if our writing or presentations were not. I still use this guide today.

When I started full-time college I found out real fast that embellishing my writing and using the passive voice not only allowed me to add more words to my papers but the professors loved it.

You're not up to date. California (I think) is planning to fine you $1000 if you call a male who "identifies" as female "he" or "it" instead of "she".
