Roosevelt announces “court-packing” plan - February 5, 1937

On February 5, 1937, President Franklin Roosevelt announces a controversial plan to expand the Supreme Court to as many as 15 judges, allegedly to make it more efficient. Critics immediately charged that Roosevelt was trying to “pack” the court and thus neutralize Supreme Court justices hostile to his New Deal.

During the previous two years, the high court had struck down several key pieces of New Deal legislation on the grounds that the laws delegated an unconstitutional amount of authority to the executive branch and the federal government. Flushed with his landslide reelection in 1936, President Roosevelt issued a proposal in February 1937 to provide retirement at full pay for all members of the court over 70. If a justice refused to retire, an “assistant” with full voting rights was to be appointed, thus ensuring Roosevelt a liberal majority. Most Republicans and many Democrats in Congress opposed the so-called “court-packing” plan.

In April, however, before the bill came to a vote in Congress, two Supreme Court justices came over to the liberal side and by a narrow majority upheld as constitutional the National Labor Relations Act and the Social Security Act. The majority opinion acknowledged that the national economy had grown to such a degree that federal regulation and control was now warranted. Roosevelt’s reorganization plan was thus unnecessary, and in July the Senate struck it down by a vote of 70 to 22. Soon after, Roosevelt had the opportunity to nominate his first Supreme Court justice, and by 1942 all but two of the justices were his appointees.

Roosevelt should have been impeached for not honoring his oath of office but imposing Arbitrary government instead.

Fascism was the fashion in the 1930’s. FDR and his ideology were on board with it.

There is nothing sacrosanct about nine. It’s law now, but the Constitution only says that there shall be a Supreme Court. It doesn’t say anything about its makeup.

If Trump gets to replace Ginsburg and at least one other Justice, watch for the next Dem President to insist that the court needs to be expanded to 11 or 13 judges again.

There is a book, you have to get on Amazon because it's not in print, called "Smoke Screen". it was written by a Democrat congressman back in the 40's. It is an absolute page turner, for me anyway, as he describes FDR's new deal. He compares him to Hitler and how he ran the Nazi Party.

This is where I got the idea that Nazi's were actually left wingers no matter what the main stream tries to sell them as. Nazi actually has "socialism" in it's name, but many don't catch things like "Volkswagen" means People's car".

This congressman even takes bills written in Germany to compare to what we were printing in the US to show that FDR's mindset was to follow the fascists. Packing the courts was not a new idea and if you look at today, it's still going on. I've been waiting for someone like Trump to bring up a dissolution of the 9th circuit to remake it in his image. If you see what they did to him for the first year, every gripe went to the 9th to get blocked for the most ignorant reasons that eventually get overturned. This is how we got no prayer in school even though we prayed for 170 years. It's how a woman was allowed to kill her baby when 80% know it's murder. Now we have legal sodomy after 230 years of it being illegal. Once you lose these things, it almost impossible to put the toothpaste back in the tube without blood.

This is true. Also, although it is up to the POTUS to appoint justices, it is up to the Senate to approve them. No president can just "pack" the court without the help of the Senate.

Yeah, I think that “nationalism” is often associated with the right wing, and “socialism” is associated with the left wing. Nazi, being the “national socialist party” seems to sit right on the fence. Since they built a strong military force, I think that that is why many today seem to associate the Nazi party with the right. However, they were very left-wing at their roots.

I always felt post WWI Treaty of Versailles was used as their source to claim victimhood of Germans (nationalism) (rather than race, gender, etc.)to promote their left wing agenda. And they’re still using victimhood (collectivism) today. Nothing has changed.

Socialism is ALWAYS left. The Nazism is socialism with control of private property via regulation, not by ownership. They are only right wing to the communist
