Normally I post Oregon Standoff matters at this time of the morning but I posted the "Oregon Live" story about the indictment of FBI Special Agent W. Joseph Astarita of the "Hostage Rescue Team" late last evening.
Some analysis of the situation.
The indictment of the FBI agent was rolled out the week before the July 4th holiday.
This is when big government, big business release the bad news that makes them look bad, the news that's embarrassing and so on.
Its at a time when you're vacationing or not working or not using media like you normally do.
The federal government intends to conduct a short trial on August 29th, the week before the Labor Day holiday.
More sweeping under the rug.
An official news conference was held yesterday after the courtroom proceeding where Special Agent Astarita appeared by the Obama Administration US Attorney Billy Williams. He was appointed from the ranks of career prosecutors December 2015 at Acting US Attorney and was not asked to resign by the Trump Administration like Obama's 'political appointees' were.
Williams brought out the indictments before his replacement was named. Maxine Bernstein of "Oregon Live" reported about a month ago that the Trump Administration US Attorney for Oregon could be appointed by the end of this week (end of June).
Williams appeared with the Sheriff of Deschutes County, Oregon (that's pronounced "de-shoots") Shane Nelson and an Oregon State Police official. The final fatal shots were fired by the OSP.
They wanted to emphasize that the shooting of LaVoy Finicum was the right thing to do, which the Oregon investigators already concluded was necessary for "officer safety". Law enforcement has the "007 privilege" upheld by many juries and judges to shoot at will when apparently "threatened".
THE REST OF US WHO ARE REALLY THREATENED HAVE TO RUN, HIDE AND ONLY TRY TO HURT THOSE WHO THREATEN US AS A LAST RESORT. THAT'S THE MESSAGE I GET IN MY WORKPLACE.
Like George Orwell's "Animal Farm" Soviet style dictatorship, "some are more equal than others" in using lethal force in the name of their safety.
Sheriff Nelson spoke about how the charges "damage the integrity of the entire law enforcement profession".
But he also spoke about the experience of going to FBI headquarters in Washington and telling people at the top the findings of his shooting team.
Namely that when he told officials including the then Deputy Director and now Acting Director of the FBI, Andrew McCabe, about the lies told by Special Agent Astarita and four of his fellow agents no action was taken against them.
They were not placed on leave like one of his officers would be in a similar situation.
In fact, the status of W. Joseph Astarita in the FBI (Is he on leave or reassigned right now?) was not disclosed by the FBI or other officials when the media asked them about it yesterday.
LaVoy Finicum's widow was in Montana this week and telling media she is being followed around by federal agents but she also reacted positively to the indictment of the FBI agent.
She believes Agent Astarita's shots contributed to the decision by the OSP to open fire on her husband and kill him.
A lawsuit is planned over LaVoy's death but the delay of the lawsuit can probably be explained by a wait for this long drawn out process of the federal government investigating its own and putting one of its own on trial to run its course.
The one agent lied, but four others did. Some suggest they were not charged so they can testify against the agent who opened fire.
When its all said and done about the "armed takeover", "armed occupation" or "armed insurrection" in Oregon last year (I CHOOSE TO CALL IT THE 'OREGON STANDOFF' AND LET US ALL DO THAT) let the record show that the first shots fired in anger and the only shots fired in anger in Oregon last year came the FBI side, not the protestors side.
Last nights post on this story from “Oregon Live”.

I know I get flamed every time I point this out, but here goes again: Finicum was armed, was committing crime of insurrection. That there is some confusion about law enforcement actions and reports is minor point in comparison. Finicum is dead because he took up arms against the US. Had he not done so, had he not participated in armed insurrection, he’d still be alive. His partners are lucky they are shot or just in jail, instead of all dead, which is what they should be. No one should be allowed to take up arms against the US, to urge others to do so, and live to tell about it. The LEOs may have issues but the killing was still justified in the end. Had it been armed Black Lives Matter or Islamic terrorists, we’d all be in agreement.
FBI has license to kill like 007.
Question: Is it insurrection to take up arms against the federal government when the federal government is violating the supreme law of the land (the Constitution)?
If not, then why does the second amendment say that it is “necessary to the security of a free State” that “the right of the people to keep and bear Arms, shall not be infringed”?
You're a sick ba$tard! The notion that Finnicum had “taken up arms against his government” is so much bull$hit you must have on waders when you write! You are an anathema to anyone who believes in the Second Amendment! How's that for your first "flame?"
I don’t support any violence against anyone, but the Oregon Standoff protest was not violent.
BUT THE FBI’S RESPONSE TO IT WAS VIOLENT.
That’s what I see when I look back at things.
Peter Hitchens over in the UK has written about British police going about in baseball caps (like the FBI agents wore in Oregon by the way) but also training with military style tactics to deal with citizens who protest.
Hitchens noted that the UK police cracked down raiding the homes of people who were protesting the Chinese Communist president’s visit to the UK.
He also noted that the militarized UK police established a more stringent cordon of protection for the Chicom ruler to keep protestors far away than they did for the former President of the United States, George W. Bush.
Trickle down dirty cops in the FBI.
They didnt take up ARMS AGAINST the US..
Allowed to carry under 2nd amendment and THEY DIDNT FIRE A SINGLE SHOT ....
They were set up and he was MURDERED....
Keep in mind obama fanned the flames by putting the two brothers in hail for TERRORISM... which was a BS charge.
BLM burns more land and destroys houses and gets a pass...
THE PROTEST was not insurrection and was PEACEFUL....
But obama wanted some dead bodies... and he got one.
You have your facts wrong. The issue here is not “insurrection” (whatever that is) but whether he pulled a gun on the FBI man or not. There is plenty of evidence that says he did not and it will all come out at the trial. You cannot possibly say whether or not it was justified in the absence of facts, and those of us who believe in the rule of law would no more be in agreement with your insane statements if it was BLM or a terrorist group.

It's also on youtube.
What gets me is Finicum repeatedly told the police they would have to shoot him as he resisted arrest, and it’s on videotape.
I don’t think I agree that he took up arms against the US. It’s on record in court that his group intended to take federal property through adverse possession. They were squatters and trespassers, not insurrectionists. If they took up arms, Finicum’s cohorts would have already been convicted of that.
I haven’t seen any claim by the government that Finicum pulled his gun. I think the Oregon state officers who fired on Finicum and killed him believed he was reaching for a gun.
The FBI agent in question was shooting at Finicum’s truck, not Finicum in particular.
They were armed when they committed their crimes, they brandished their weapons, they called on their followers to arm themselves and join them. They occupied federal property while armed, which is implied threat overall. They rejected US government authority. Heck, what more is needed? If they were Islamic or Black Lives Matter, we’d all be saying shoot them and be done with it.
Most of those people have already been tried in court. Where are their convictions for insurrection?
Our Founding Fathers would maybe disagree with you. The 2nd Amendment and many statements by them belie your sensibilities.
It is time for a complete reorganization of the FBI or a dissolution and bottom-up replacement.
The killing was sure as hell NOT justified unless you are of the -common on FR- belief that LEOs Can Do No Wrong which would make of us a true police state. They should have been and were arrested and the courts are the correct forum for adjudication, not some agent’s itching to notch his gunstock.
This one bears watching.
I’m wanting to be pinged on this one.
