Gingrich: Mueller Investigation 'Poisoned Fruit' After Comey Testimony

In his testimony Thursday, former FBI Director James Comey's statement about leaking information of private conversations he had with President Donald Trump revealed the special counsel investigation led by Robert Mueller was "poisoned fruit," stated former House Speaker Newt Gingrich.

Comey admitted he leaked the information as part of the FBI's probe into Russia's involvement in U.S. elections and the connections of the president's former national security adviser Michael Flynn with Russian officials.

"I asked a friend of mine to share the content of the memo with a reporter – didn't do it myself for a variety of reasons – but I asked him to, because I thought that might prompt the appointment of a special counsel," Comey testified before the Senate Intelligence Committee.

Gingrich called this "the most startling revelation" from the day's testimony, as it was a "barefaced admission" of his intent to leak the documents in hopes a special counsel would be appointed to investigate the charges.

"This statement is tremendously important because it completely delegitimizes Robert Mueller's so-called independent investigation and reveals it as poisoned fruit," Gingrich wrote in his weekly newsletter on Friday.

Hopefully, Sessions will Un - Recuse himself from the fake Russian investigation.

They need to call Putin to testify. LOL Putin will call out the lying liberal media in real time.

The only brilliant legal mind that counts in this matter is Jeff Sessions and he determined that he needed to recuse himself. The law he relied on in making that decision was 28 CFR 45.2. You can look it up and read it for yourself. Or not - Your choice.

It has been interesting but it is getting late and this old man needs to get some sleep. Have a good night.

I've posted my reasoning a few times as to why AG Sessions was correct to recuse himself, but here goes, again:

This bogus investigation situation could go on forever. If AG Sessions were involved, it would suck him in. Instead, he can stay out of that black hole and actually get things done.

The coup wants to get AG Sessions out of that position. Doesn't that tell you all you need to know?

I'm quite frankly suspicious of any Deplorable who has anything but 100% support for AG Sessions. It was obvious on the campaign trail why AG Sessions is so important. President Trump was at his very best with AG Sessions at his side, mentoring him.

I was Sessions’ biggest fan on the campaign trail and as attorney general nominee. However, to me, one of his most important jobs was to be the firewall against the deep state’s efforts to get Trump. Holder performed that role, not against the deep state but against conservative efforts on things like fast and furious and Benghazi. Lynch did it, too, on things like Hillary’s email. If the AG refuses to do anything about an allegation, that is that. Congress can have their ineffectual committee brouhahas but they come to nothing. But allow a special prosecutor, and all sorts of mischief can result, and has. Sessions should not have been suckered into recusal. That was a bit mistake.

No. 2 problem I have with him is that, while we all knew that the deep state was coming after Trump with everything it could, we would need to hit back at the big state with the full power of the DOJ. Just as the DOJ in the space of a few short years created Black Lives Matter and turned the cops into hunted creatures, it could be used to protect conservatives and Christians under assault, prosecute those who assist illegals and go after those in the deep state for their perversions. We need to know the dirt that the democrats use on Republicans and neutralize it. Otherwise, Trump will be under assault for 4 years and get nothing done, and then lose reelection.

No. 3 was the fiasco with the immigration EO. The briefs were crap, the lawyers arguing were lousy and that was intentionally so. They were Obama holdovers. He needed to have reliable conservative lawyers in place for that early important high profile court battle. The result would no doubt have been the same, but the presentation would have been much better, and given the Administration a stronger case to make to the American people about how lawless the courts were.

I know that the left wants Sessions gone, and I want him to continue. He is talented, smart and conservative. But his performance has been lacking in some ways. I just want him to be tougher, faster and more aware of the problems that this administration faces. I want him to use his office the way that democrats have, and really take it to the left, not just be defensive and reactive. It’s not too much to ask. And as an outsider, I always leave open the possiibility that there are things going on I don’t know about and reasons for why things are unfolding this way that could not be helped.

I’m suspicous of you for requiring 100 percent of Sessions without criticism.

Keep in mind that the confirmation of AG Sessions was slow-walked. He was treated horrifically. That meant any work early on was done without AG Sessions or anyone he would appoint. Now, the coup still works to prevent him from taking full control as Attorney General.

President Trump could not have done it without Senator Sessions and his aide Steve Miller. They were tireless, effective, and unrelenting in giving it all to support Trump's campaign.

You don't hear the coup finding flaws with their group. What you're doing by finding flaws is inappropriate and only serves to feed the beast. That beast is the coup which is well underway. Do you seriously think President Trump can succeed without AG Sessions legal expertise, DC experience, and steady hand? If you're going to criticize anyone, how about sticking to the disgusting globalist elite "Republican" (ie: only when they're campaigning) insiders who still don't seem real interested in having Trump's presidency succeed?

it looks to me as if the “coup” is getting everything they want with the recusal of Sessions and the appointment of Mueller, who is a close friend of James Comey, a Clinton baggage carrier. Trump is the one who is in the most need of protection from the deep state, not sessions.

“Shortly after being sworn in, Attorney General Sessions began consulting with career Department of Justice ethics officials to determine whether he should recuse himself from any existing or future investigations of any matters related in any way to the campaigns for President of the United States.

Those discussions were centered upon 28 CFR 45.2, which provides that a Department of Justice attorney should not participate in investigations that may involve entities or individuals with whom the attorney has a political or personal relationship. That regulation goes on to define “political relationship” as:

“[A] close identification with an elected official, a candidate (whether or not successful) for elective, public office, a political party, or a campaign organization, arising from service as a principal adviser thereto or a principal official thereof ***”

Given Attorney General Sessions’ participation in President Trump’s campaign, it was for that reason, and that reason alone, the Attorney General made the decision on March 2, 2017 to recuse himself from any existing or future investigations of any matters related in any way to the campaigns for President of the United States.”

and should this not also apply to special counsel Robert Mueller, who should be required to recuse himself?

I would think that a a general matter, Mueller would be covered under this law since he is an employee of the Justice Department. It would then depend on the fact pattern that exist. First, it would have to be determined if Comey was a subject of the investigation which. If the answer was yes, then the type relationship between them would have to be looked at. They have had a working relationship which would probably not be disqualifying. On the question of a personal relationship, I wouldn't know. Considering Mueller is 72 years old and Comey is only in his mid fifties, I would doubt any friendship would have gone much beyond a working relationship.
