FULL TITLE: Homeowner who found a 'naked' teacher's aide taking a SHOWER in his house, left to get his gun and then returned to shoot the 'intruder' dead through the bath curtain is charged with murder
An intruder who was shot dead by a homeowner after breaking in and using the shower has been identified as a 31-year-old teacher's aide.
Nathaniel Joseph Rosa was killed on Saturday morning inside the bathroom of a property in Belfair, Washington.
The man who owns the property has been charged with murder.
Police said the homeowner, who has not been named, called 911 shortly after 8am on Saturday and told the dispatcher he had shot an intruder.

What an idiot to tell the cops that he ‘left’ to fetch a gun. He could have shut his stupid mouth and the prosecution would have to prove that he left to get his gun. Did I say he was a moron?

When he left, he could have called the police.
This seems more like he WANTED to shoot something dead, and thought he had a great excuse (intruder in his home) to do it.
The charge is appropriate. If that is the story the jury hears I expect they find him guilty.
The homeowner left the scene, period.
When he left the scene he was no longer in imminent danger, period.
He returned with a gun and shot the intruder, period.
He's going to jail, as he should.

Oh, trust the police as long as you are not in a predicament. The moment you are in a predicament, trust your lawyer. Lol.
SOOOO he finds the guy in the shower, talks with him, then leaves to get his gun and goes back and then shoot him? How can he claim threat or self defense if he voluntarily returned to the scene? And then shot the guy through the shower curtain?

Absolutely he should be charged.
You can only shoot someone if you are in fear for your life or limb, and in some states, for your property. Washington state is not one of the property-states.
Ergo: If you leave freely, then return with a firearm, you clearly were not in fear for your life or limb. You were able to leave. You did not call the police, instead, you returned to an area of possible danger.
That makes it impossible to claim you were in fear for your life or limb. Thus, murder.
Q.E.D.
The moral of the story: don’t talk to the cops if you think you could be in any legal trouble. Cops work for the prosecution. Remember that.

I agree with you. I wouldn’t have shot the guy, unless he made a move toward me, but what’s next? He and five buddies playing poker in there? Kicking back in my tv room?

I’m not saying the guy was not a danger, but if he’s naked and soaped up in the shower, he’s not exactly crouched behind a piece of furniture waiting to shoot the homeowner. Should he have been there? Of course not. I suspect that seeing as the guy was in the shower, he may not even have known that the homeowner came in, saw him taking a shower, and left again. The intruder could have been shot without even knowing he had been discovered. He should have been arrested.
What everybody seems to be missing is when he came back he shot the guy through the wall. He had no chance to surrender. He shot him in the back. That might fly in Texas, but doubtful in the UK.
