First The Government Went After ExxonMobil -- Now They're Going After Me
Forbes ^ | 16 Jun, 2016 | Alex Epstein

Massachusetts Attorney General Maura Healey is persecuting ExxonMobil XOM +0.44% and now me for having opinions on fossil FOSL +3.61% fuels she disagrees with. My company, the Center for Industrial Progress, is one of the 12 cited in the new subpoena of Exxon, meaning that Exxon is supposed to release any private or confidential correspondence any of its employees have ever had with anyone from my company. I have nothing to fear whatsoever about what such a witch-hunt would or wouldn’t reveal on my end, but I do not tolerate anyone violating my rights.

So I wrote the Attorney General a three-word response that is not appropriate for a family publication. See it here.

That is all she deserved but it’s worth elaborating on some of the legal, moral, and scientific questions involved, particularly since the word “fraud” has been thrown around.

The government has no right to demand a single email of mine or Exxon’s unless it has evidence that we are committing fraud by concealing or fabricating evidence. In the case of the climate impact of CO2, this is impossible–because all the evidence about CO2 and climate is in the public domain, largely collected and disseminated by government agencies or government-funded educational institutions.

“Apparently, Exxon was (rightly) suspicious of these claims and the Al Gore-led funding bonanza of scientists who agreed with them. Exxon refused to endorse climate catastrophism and funded alternative research–which they had every right to do even if they ended up being wrong. But they ended up being right. The speculative claims turned out to be false. We have experienced mild (not runaway) warming that is only loosely correlated with CO2–and global fossil fueled development has helped bring climate-related deaths to an all-time low. How can you say #ExxonKnew about an imminent climate catastrophe that wasn’t real?”

I can’t find the details now, but I recall Gore speaking and saying that an island in the Pacific had already “disappeared under rising waters” and the people evacuated to Australia. Gore was stupid enough at a later date to go and speak in Australia. Unlike the cowards we have posing as “journalists” in this country, they called him on it and asked the name of the island, the people, and where they were placed in Australia. Evidently, Gore just sputtered for a few seconds, left the stage, and took his heavy carbon footprint jet to parts unknown.

Just stall and drag it out as long as possible. This will be one horrific winter followed by possibly our first mini ice age winter in 2017-2018. They will look ridiculous.

Don’t be concerned about the suit.

I can not imagine the attorney general not realizing that when you sue someone both parties have the power of discovery. That power on the part of the defence in this case would destroy he plaintiff.

If it is going o be a criminal case, there still are laws to the effect that exculpatory evidence must be presented to the lawyers for the defense.

OK, then the defense lawyers should point out that the records of the climate scammers are to be revealed to the defense.

In either case, the prosecution will suffer a thousand deaths.
