Synopsis: The US Patent Office invalidated two of the three in suit patents on selling digital software online held by SmartFlash LLC. A third similar SmartFlash digital selling patent was invalidated in March in another case. The Patent Office judges held that the patents were for abstract concepts, just mere ideas, and should never have been granted patents in the first place. Swordmaker

The US Patent Office invalidated two of SmartFlash LLC's patents where they claim to have a patent on the method of selling digital content or files on the Internet. . . All digital content or files of any type that can be stored and then purchased by paying money for access to download any type of file. The panel of judges ruled this was an abstract concept, an idea, which is inherently non-patentable. The two patents of this type were used as part of the $533 million judgement against Apple which was on appeal. Another similar digital file for pay patent was invalidated in March which was also held by SmartFlash LLC. PING! Pinging dayglored, ThunderSleeps, and Shadow Ace because it effects all digital content for sale on the Internet.
