San Bernadino County is calling out the FBI and DOJ.
They are all pointing fingers . . . Apple is just reporting objective findings. Apple has never had custody of the iPhone in question since it left its hands at sale.

Apple is & has been out of the loop in my opinion. Now more than ever. If the FBI thought they were in such dire need of Apple's help, they would have not touched the phone (other than trying one or 2 passcodes), much less request the IT guy to change a password.
This has never been about one particular phone. It is about the endgame.
