Apple Sues to Stop BYD Precision from Gaining an Order in China to stop iPhone 6 Plus Production

Apple filed a 'Petition for Order Compelling Arbitration and for Injunctive Relief Pending Arbitration' against BYD Precision Manufacturing Co. Ltd and BYD Company Limited on October 29th. Ever since that time, additional filings have been flying into court fast and furious with both redacted and unredacted exhibits and various other motions. Just yesterday the case was reassigned to Judge Hon. Richard Seeborg. The case involves certain iPad mini and iPhone 6 Plus (and presumably iPhone 6s Plus) products using antenna technology from BYD. BYD is trying to stop Apple's production of the noted products in Chinese Courts which would cause great harm to Apple and their reputation. Apple is racing against the clock to stop the patent infringement lawsuits and the orders to cease production in particular due to a Master agreement that BYD signed which allows Apple and their suppliers to use their patented technology.

Apple licensed the patented antenna making technology from BYD Precision in 2011, and this company agreed to not file any infringement suits due to that licensing against Apple or any of Apple's subsidiaries. In October BYD filed patent infringement suits against three of Apple's Chinese subsidiaries without warning, ignoring the licensing agreement's requirement that any dispute had to be settled by binding arbitration in a California Court in San Francisco. . . and it's not as if BYD does not have a California presence. . . they do.

Apple has filed to compell arbitration with a Chinese company it has licensed some patents from to stop them from getting a Chinese injunction which would stop manufactururing of iPhone 6plus and 6S plus, because the company has filed patent infringement claims, despite the licenses and agreements they would not file infringement suits, and also agreements they would settle any disputes with binding arbitration in a court both companies had agreed on. -- PING!

Maybe Apple needs to build a plant in the United States. Apple certainly has the money in the bank to do it.
