Confident he is going to beat back a $40 million fraud lawsuit by Attorney General Eric Schneiderman, billionaire developer Donald Trump said Thursday he is considering re-opening his defunct Trump University.

As soon as this case is over, we will consider re-opening the school to all our students and hire back the teachers and others, thereby creating lots of jobs for New York," Trump said in a statement.

The reality TV star said expects to also bring a malicious prosecution lawsuit against Schneiderman, who he calls "a total lightweight who is considered by many, including myself, to be the worst Attorney General in the United States."

Manhattan state Supreme Court Judge Cynthia Kern on Wednesday rejected Trump's attempt to bring a malicious prosecution lawsuit, saying it was premature with the state's case against him still ongoing.

Kern in her decision dismissed two causes of actions brought by Schneiderman against Trump, leaving only the two main charges that Trump University defrauded thousands of students left to be litigated. She rejected Schneiderman's attempt for a ruling in the state's favor without a trial. She also wrote that many of Schneiderman’s claims fall outside the three-year statute of limitations window or contained evidence that was not admissible.

Trump in his statement said the judge's decision creates "a very heavy burden for the attorney general to win."

Schneiderman’s office filed suit last year claiming that Trump University ripped off 5,000 students nationwide by promising to make them rich when instead they were steered into costly and mostly useless seminars.

“Now that a court of law has found Mr. Trump personally liable for violating the State’s education law, we look forward to proving the rest of our case at trial.”

Trump, who says he has rebuffed any settlement talks with Schneiderman's office, charged that the AG has used taxpayer dollars "trying to build his name and reputation by going after me and now his entire case has been totally decimated."

In a bit of irony, Trump branded Schneiderman "publicity- mad." He said the AG "is desperately trying to change his weak and ineffective image with the voters prior to election."

"This all for a school that has a 98% approval rating from its students...In my opinion, he is a corrupt politician."

Kern did rule that Trump knowingly ran an unlicensed school, a point The Donald tried to downplay. He said the largest fine for such a violation in state history has been a few thousand dollars.

"We will appeal this part of the decision," he said.

UPDATE: In response to Trump's comments, Schneiderman spokesman Damien LaVera said: "Now that a court of law has found Mr. Trump personally liable for violating the state’s education law, we look forward to proving the rest of our case at trial.”

Really? How many other the hundreds of on-line universities have also violated ‘the state’s education law’, hmm?

How many Religious conservatives are curious about that? Are home-schoolers next?

He said ILLEGALs can stay in America and have a "path to legal status" as long as they are productive".

Perhaps he will help them become productive.

“Damage control.”

Not needed. Trump will once again win. Of course you are afraid he will WIN the Presidency also, aren’t you? Fear, the great motivator for you to continue to post your inane remarks about The Donald. The Donald, winner; you, l

I don’t know....what happened to this case? Was it ever settled? Winning or losing is, to me, not the important part of the article, but what happened afterwards is....

I have no such fears. I know clown Trump has no chance of winning the general election. But should the gullible nominate this life-long liberal democRAT as the Republican nominee, my fear is it will ensure a Hillary landslide.

Wrong. Trump will get all of the Reagan Democrats. Trump talks their kind of talk. Blunt and to the point.

If that’s what it takes for you to rationalize your support for a liberal democRAT go with it.

There’s a hundred people giving this type of seminar...and they are rich just like trump. The difference is they got rich via their seminars alone.
