So I saw several years of complaints that Obama was born in Kenya. Lets assume he was. His mother is an American citizen; there isn't any dispute there. And, in the minds of those who believe he was born in Kenya, that means he's not eligible to be President.
Lets move to Ted Cruz. He was born in Canada. His father wasn't a US Citizen at the time of his birth. His mother was. So if Obama being born in Kenya supposedly matters, why does Cruz being born in Canada NOT matter?
No confusion.
After Obama — it just doesn’t matter anymore.
According to Title 8 section 1401 of the US Code, Congress has expressed it’s will with regards to the enumerated and unrestricted power to make the rules of naturalization. This includes who needs naturalization and who does not.
At the time of Obama’s birth, those rules were slightly different than today’s rules. Understand that there are two paths to NBC status, but both are dependent on being born a US citizen and not requiring naturalization. At the time of Obama’s birth, the US citizen parent of a child could confer citizenship but only if they had met certain requirements. Obama’s mother did not and thus could not have passed citizenship at birth. That is why the Obama team has been so focused on LOCATION. If Obama was born in the US, then he is a NBC, no question.
Mr Cruz is a NBC as his mother fully met the requirements to pass citizenship at birth.
Cruz is an American, and Obama isn’t, regardless of where they were born.
When Bammy’s mom plopped out a steaming pile of obama, if she did it in Kenya she would have been too young to convey U.S. citizenship to it.
Cruz’s Mother was plenty old to be able to convey citizenship to Cruz even if he was Born on the moon.
Because he was a U.S. citizen at birth (his mother was a U.S. citizen who lived in the U.S. for more than 10 years as required by the Nationality Act of 1940), most commentators believe Cruz is eligible to serve as President of the United States.

Yeah, sure he was.
Personally, my problem with Obama was/is with the lies about his birth.
As so often is the case, the cover-up is worse than the crime.
Being a liar disqualifies a person to be president, imo.
I believe the bone of contention that IF he were born in Kenya, his Mother not being 18 years old yet would not confer citizenship on her son. Some convoluted thing about it if I recall correctly.
The immigration law at the time of their birth required the mother to have 5 years of residence after age 17 to confer status if the child was born overseas and the father could not qualify. If Obama had been born in Kenya, he would not have qualified. (There are other rules that disqualified them, but don’t need to be rehashed here.) Those same rules grant Cruz citizenship at birth - which meets the court’s definition of Natural Born.
In 1986 and 2000 the rules were changed again to make it even easier to qualify...
If he was born in Hawaii, then he is a NBC. However, there is a dispute as he has never produced the proper record to show that he was in fact, born in Hawaii.
as for lil Barry, my thinking is, both his parents were American citizens. Barack Obama, the Kenyan was a strawman brought in to give the little bastard a last name. Barry Marshall probably did not play too well with Grandma and Grandpa.
The difference being that his Mommy Stanley Ann Dunhamwas not yet 19 years old when he was born so she could not pass on American citizenship to him..Granted he was not automatically Kenyan through his Dad because he was illegitimate and therefore couldn’t claim a father’s nationally...
Wherever his Mom was when he was born would be his nationality..theres no proof Stanley Ann Dunham gave birth to a boy child on or around August 1961 within US territory..
Very few people actually believe that Obama was born in Kenya. Quite a few people however believe that he is hiding SOMETHING about his birth due to the forged and contradictory birth certificates, none of which has ever been examined on paper by an impartial document examiner. I’ve always said he’s probably eligible and that he probably revealed whatever it is he’s hiding to Justice Roberts prior to the second swearing-in. If I had to guess I’d say that he had a different name and a different father neither of which fit the fictional life-narrative he has trumpeted all his life.
Except his mother was 18 when he was born.
Ann Dunham, born November 29, 1942
Barack Obama, born August 4, 1961
If mom is unmarried, the child takes moms citizenshio. If married then dads.
So you lost the argument during two presidential elections, and now that the democrat is leaving office after serving two terms, you want to use the argument against the conservative?
[ ....citizenship at birth of one born outside of the United States to only one citizen-parent, that such citizen parent have resided in the United States for not less than ten years, at least five of which were after the age of fourteen (8 U.S.C. §1401(a)(7)) (1958 ed.) We all know Mr. Obamas mother didnt met this requirement.
Problem is - he was born in Hawaii. ]
Which is fine, but I’ll bet a bushel of corn that Obammy has college docs that says he applied for foreign student aid as an Indonesian Citizen.
I think some of the “birther flap” was done via the Obama side of things to point at the BC while they carefully swept his damming college application docs and selective service docs under a giant persian rug....
Obama’s mother was only 17, too young to transmit citizenship under the then current law. Obama’s US citizenship is thus entirely dependent on his being born on US soil.
Ted Cruz’ mother was an adult able to transmit citizenship. He is a natural born US citizen in spite of the fact that he was born in Calgary.
The problem with Obama was that his mother was too young at the time of his birth, but that’s something of a technicality. More important is that he tried to foist a forged birth certificate off as his, and that he may have given up his citizenship.
The dims will cry bloody murder over the same set of circumstances. Rules just don’t apply to them.
