It could be a week before we know whether a Longmont woman who allegedly stabbed a pregnant woman and removed her unborn child will face a charge of first degree murder. The Boulder District Attorney says a murder charge is not a given because of Colorado laws and the facts surrounding the case.
During a news conference Thursday District Attorney Stan Garnett said any murder charge involving an unborn child is very difficult.
“Under Colorado law, essentially, there’s no way murder charges can be brought if it’s not established that the fetus lived as a child outside the body of the mother for some period of time,” Garnett said.
There is a chance Dynel Lane will face a murder charge. According to the arrest affidavit, her boyfriend told police that he heard the baby gasp for air after already being removed from her mother, but Garnett said they’ll have to wait for an autopsy in order to better understand whether the child lived on her own.

I think in a case such as this it must be counted as a murder.
Anyone who carves into a pregnant woman to get at the child, is certainly guilty of attempted murder of both, and if the baby dies, I don’t think in such a case as being ripped out of a belly should there have to be any evidence required to declare the baby was murdered.
Yes common sense is not law. Don’t need to hear responses such as this.
The murderer is a woman.
Woman that do this cannot possibly be evil; her lawyer will go for insanity.
Only men that do bad things are evil. When women do them they “must” be insane.
Women can cry and fake remorse and people buy it. With men nobody cares.
I wish nobody cared in both cases. But they do not. Too many people buy into the theatrics and manipulation of female criminals.

Better point is: Why do libs care? They are fine with baby murdering. Why does this bother them?
Because there’s a hierarchy of liberal beliefs. They often clash and then they have to decide which one takes precedent.
In this case abortion/feminist pretzel logic trumps race pretzel logic.

BULLSTALIN. if a teenaged girl did this to herself in a bathroom, prosecutors would be lining up to charge her with murdering her own baby.
Charge this woman with practicing medicine without a license. Charge her with an act of sexual violence.

I’m presuming the mother of the child didn’t die, but I’m pretty sure they will charge the assailant with attempted murder in the assault on the mother, they certainly should at least.
Another black on white crime! Maybe someone needs to make a poster of a newly aborted baby cut from its mother womb with its hands up and saying, “I can’t breathe?”

The news reported that the husband of the killer was clueless and thought this was his own child. They said he told the hospital that he had heard the infant gasping for air. That means she was born alive. How can this not be murder???
I want to be in a small room with this Dynel person. I’ll need 15 seconds. Several hours would be more fun, but 15 seconds will do nicely.
