U.Va. Student From Chicago Brutally Beaten During Arrest

Virginia Gov. Terry McAuliffe is calling for an investigation into the arrest of a college student with Chicago ties who was shown in a photo with a bloody face as he was held down by an officer.

Charlottesville General District Court records show that Martese Johnson is charged on two counts: obstruction of justice without force, and public swearing or intoxication.

The Alcoholic Beverage Control agent who made the arrest Wednesday morning, listed in court records as J. Miller, said in the arrest report that Johnson "was very agitated and belligerent."

A statement from a group calling itself "Concerned Black Students" claims the arrest of Johnson was unprovoked and extreme.

"The brutish force used resulted in his head and bodily injuries," the group said in a statement. "His treatment was unprovoked as he did not resist questioning or arrest."

Johnson, whose Twitter page identifies himself as a Kenwood Academy High School graduate from Chicago, did not immediately return an email seeking comment. McAuliffe's office issued a statement asking state police to investigate "the use of force in this matter."

The ABC issued a statement saying that "uniformed ABC Agents observed and approached" an unidentified individual "after he was refused entry to a licensed establishment" around 12:45 a.m. at an area of bars and restaurants near campus known as "the corner."

The ABC said the unnamed individual received injuries while being arrested and was treated at a local hospital before being released.

A photograph provided to The Associated Press by a witness shows Johnson lying on the ground with blood streaming down his face. The Concerned Black Students group said Johnson required 10 stitches.

The ABC said the agents involved with the arrest are being restricted to administrative duties while a state police investigation is underway.

ABC agents in Charlottesville have been accused of heavy-handed actions in the past.

The state of Virginia reached a $212,500 settlement last year with a UVA student who was arrested after her purchase of water was mistaken for beer.

Elizabeth Daly fled in terror outside a Charlottesville supermarket in April 2013 when her vehicle was swarmed by state ABC agents who mistook her just-purchased carton of sparkling water for beer.

Daly was charged with eluding police and assaulting a police officer after her SUV grazed two of the agents. The arrest provoked a public outcry, and the charges were dropped.

I was looking at the title of the article - this really doesn’t look like “brutally beaten” by cops. And, I’m wondering if there isn’t more to this story. College town bars/bartenders/bouncers are (not surprisingly) pretty experienced judges of “too drunk to serve”. Or, was he not allowed into the bar because they don’t serve “that” (black, not drunk) kind? I don’t think so.

Waiting for the photos of this kid in band uniform in 3...2...1...

But I have actually seen people more seriously injured falling off a bar stool.

And there’s the typical group of people who watch a video that doesn’t show the whole incident, then assume that the comments from the activist who took the video are actually evidence.

If you spend a little time doing ride-alongs, you’ll see this stuff all the time: guy is drunk and disorderly, cop tries to calm him down, guy fights, cop takes him to the ground to cuff him, and the guy gets a facial laceration. Five seconds after he realizes he’s not going to avoid arrest he starts the whole “you’re only doing this to me because I’m black” routine. It’s all a common and often repeated act, you’ll see it any weekend in a decent sized city.

The only thing that’s changed is the agitators are getting more sophisticated, their useful idiot enablers are getting dumber, and the media is hyping every incident.

Several questions arise.

How old is the kid? Drinking age in Virginia is 21. Oddly, the reporter never gives the kid’s age. Normally, even if you had a car accident.....they’d say your name and give your age....but in this case...they avoided the age mention. So, I’m guessing the kid is 19 or 20....thus illegally drunk.

Next question....school night....1245AM...why is this kid out still drinking on a school night? If this had been Friday or Saturday night....I could understand this type of behavior.

Next question...was the kid drunk? Nothing I can see would suggest a degree of drunkenness....or was he entirely drunk?

Anyone who has seen a single episode of “Cops” would know that when a drunk perp (whether white or black) resists arrest and requires being taken down to the ground to be subdued and handcuffed risks hitting their head while being taken down. That is almost certainly what happened here.
