MALIBU, Calif. Gender-bender reality-TV star Bruce Jenner rear-ended a car Saturday, causing an accident that killed a woman motorist.
Seven other people were injured in the accident, which happened shortly after noon on the Pacific Coast Highway near its intersection with Corral Canyon Road.
Jenners dark blue Cadillac Escalade was towing a dune buggy in a trailer when he rear-ended a white Lexus sedan being driven by an elderly woman.

I thought the same as you, and I still do sort of, until this happened. By the way every last attorney I have told this story to is dumbfounded by the results.
Do you know for a fact that the Prius was a papo? Whoa, that is horrible and that actually makes sense, because:
THE PHOTOS WHICH SHOWED THE CARS BEFORE, DURING, AND AFTER THE ACCIDENT WERE TAKEN FROM THE BEACH SIDE OF THE ROAD and appeared within minutes on TMZ.
Why would anyone standing in the middle of nowhere on pch have their telephoto lens zeroed in on drivers coming in the opposite direction (they were standing near the south facing side and the accident was on the north facing side)????
Unless they were told to stand there, someone would have jenner be stopped there, for the best shot to see if he had freaking nail polish on.
Has it gotten that crazy???
Bottom line, if someone brakes for hazardous debris, and you rear end them, you lose.
End of story.
I ran over an entire truck re-tread that had unpeeled itself and was lying in the road. I was driving an RV. Front-engine Class A. Took out the muffler/exhaust pipe, which then banged into the driveshaft, rendering it out of balance, then ripped off a bumper piece from the trailer I was towing, and the exhaust pipe chunked out one of the trailer tires. No way to avoid the tread - it was lying across the lane, and appeared to be the entire cap. There was a semi to my left, and a ditch to my right. Just had to ride it out.
I'm really glad I was pulling a trailer, and not my tow vehicle. It could have been even more expensive.
There is and was No at fault accident on my record, Triple A wrote the new policy. Farmers still bought me a new truck though.
Look, it doesn’t matter of Obama was nude and riding a jackass down the center divider while taking your pic. If you rear end the vehicle in front of you, you’re at fault.
You bet, if there is no where to go, you’re going to hit the debris, as it seems you did. And if you would have swerved into the truck, you’d be liable.

I used to smoke and would typically hold it in my right hand. Except when I was driving, then my right hand held the coffee. ;)
Yeah, it happened to my teen son, his first time on the freeway. He was at fault 100%, luckily only fender benders, no injuries. I am so glad it wasn’t like this one.
However, upthread a freeper had this happen and only got 10% guilt.
Seriously, if the Prius is connected to the people standing roadside taking stop action telephoto shots BEFORE AN ACCIDENT, Bruce won’t get much criminal negligence. Could still be sued for wrongful death up the wazoo. And he will have a wazoo by then.
Which hand his cigarette was in can be seen in the photo, no debate.
Also on tmz it can be seen that Bruce swerved to the right to avoid the white sedan. Because of that, she went to the left.
He may not be at fault.
Absolutely, if the rear ended vehicle was proved to be part of the press and attempting to slow the he/she down so pics could be taken, the dead’s insurance company will be totally liable.
But I am real confident this is not the case here.

I’ve read here that the Prius was a normal person, but haven’t seen that anywhere else.
There is at least one black Prius used by a paparazzi though. Google Justin Bieber rear-ended.
It’s common for someone not paying attention to turn at the last split second in a last ditch effort to avoid rear ending someone.
In addition, the impact can throw the rear ended vehicle in the opposing direction of the impact. IOW, if a vehicle is impacted off center on the right rear end for instance, the impacted vehicle will move forward to the left in many cases. In this case it seems, into on-coming traffic.
Like billiard balls.
One more thing, a rear end impact can cause the driver being rear ended to inadvertently push the accelerator if their foot is resting on it/over it, as a natural reaction to brace.
