Part of the problem is there are WAY WAY too many laws on the books. We’ve given the cops too many excuses to turn people’s lives upside down. For no good reason.

What's the solution, you think?

When someone says they aren't going to comply with an arrest, should the cops say: "Hey, bro. Not in the mood to come down to the station? I totally get it, dude. Here's our address - when you feel like stopping by, we'll have a holding cell ready for you."

What should they have done? Just let him take charge of the situation? Defer to his "feelings"?

I reread the story again.

So, the police thought that the guy had been selling cigarettes illegally. Did the police have proof, that he was selling cigarettes illegally?

My concern here is, were the police in the process of making a formal arrest? or did they want to handcuff the guy so that they could continue their investigation to see if he had been engaged in illegal activity?

The handcuffs should only come out if the cops are in the process of making an arrest. I have seen too much of this where the cops handcuff someone for their own safety as the continue to troll for evidence.

If it turns out that this man was not engaged in illegal activity, then these cops should all go to jail. This, ‘Us’, against, ‘Them’, mentatlilty must end...

It USED TO BE that the local citizens could convene a grand jury w/o the blessings of the judiciary.

Just regular people.

Not anymore...

(they still can in six states)

The standard for arrest is not "proof" - that's a standard for conviction.

The standard for detaining someone is, and always has been, "probable cause."

I bet his concern was they continued choking him to death after he repeatedly gasped the words, "I can't breath" over and over.

Sad to see - one thing is sure : If this happened in a city run by a Republican - even a rino - Al and Jesse would be marching. But we'll never hear about this again.
I worked in the next precinct over from where this happened. I've watch the video and I can't figure out what was so urgent about bring this guy down. No weapon no fighting nothing. He sold cigarettes illegally? AND?

If someone is not alive to answer a phone, that fact is not probative that they were killed versus dying of natural causes.

A homicide, even a negligent homicide, is based on the accused having a reasonable expectation that the dead man would die as a direct result of his action or inaction.

Every year many, many hundreds of big guys who resist arrest find themselves in a choke hold.

Very few die of a massive coronary.
