SURPRISE, Ariz. (CBS Las Vegas) – A mother is upset after her 5-year-old son received detention for what his school is calling “sexual misconduct.”
Eric Lopez, a kindergartner at Ashton Ranch Elementary School, pulled his pants down on the playground this past spring. The child received detention and has a note within his permanent file at the school. At the time of the incident, his mother wasn’t notified nor did school officials inform her that her son signed a note in the assistant principal’s office.
“He did not know that he could ask for me,” Eric’s mother, Erica Martinez, told KTVK. “He’s 5.” Dysart Unified School District has a policy that states a parent does not have to be present for a disciplinary meeting unless the student requests his or her parent.
For the past two months, Martinez has been fighting to have the sexual misconduct label removed from her son’s file citing that her son’s actions were not sexual in any way. But the district has denied her appeal and the assistant superintendent is defending the school’s actions.

When my brother was two he stripped off all his clothes and hopped into a pool with the little girl down the street. Then (late 70’s) it was just funny, now he’d probably get arrested.
Five year old kids know nothing about sex, much less sexual misconduct. This is much-ado about nothing.

At age 5, being bullied, those kids will be compelled to submit by an overwhelming group. Then again, where was the teacher or other ADULT supervision during this time?
Those kids that taunted him should SIGN the Anti-Sexual Harassment paperwork for the verbal peer pressure they put on the 5 yr old. This boy was abused by his other classmates and this is how the school handles it???

I agree it should be a nothing event but the school decided to elevate by noting his file with a sexual misconduct. That will follow him throughout his school life and perhaps into later life especially if he becomes a conservative politician and some enterprising Obama type liberal gets access it during an election.

This shows the sick mind of government school “educators”. It is inconceivable to them that a five-year-old is not sexual. I guess his mistake was not taking his pants down with another boy.
The teachers are not there for the benefit of your children, nor are they there to protect their rights.
They are there to educate them in the ways and manners of obedience to politically correct dogma. Nothing more.
Assistant superintendent Jim Dean should be stripped of his pension and put in prison.

That was kinda my question. Did they have to explain to the young lad what sexual misconduct is, or did they just go straight to the signing away of rights...

When I was a kid (back in the far away time called the 80s), everyone would have said “ewwwww”. The girls would have told the playground monitor, and she would have yelled for him to knock it off. or made him sit by the door until recess was over.
