Three men are facing charges in Pasco County for poaching deer on private property and hunting out of season.
Officials with the Florida Fish and Wildlife Commission say they caught the men on February 27 on private land near Bellamy Brothers Boulevard in Dade City.
Officers said they noticed spotlights in operation and heard multiple gunshots coming from private property nearby. Around 1 a.m., officers said they found Jason Payne, Eric Ohmdahl and Marc Laird cleaning six deer on Payne's property.
Officers took three rifles with lights attached and six bags of deer meat.
All three men were charged with first-degree misdemeanors, including taking deer during closed season.
I intentionally used the term “King’s deer” as the history of out game laws can trace its roots to English Common law where the “state” was the King.
About a trillion years ago my cousin’s husband made the papers by getting caught carrying out the last remaining buck in Pasco county. Out of season naturally. :-)

Just curious, does that change your response on this? Do you think this arrest is unjust as a result?
I see a lot of people saying that wildlife “belong to the state” while others think that’s an anachronistic, fascist viewpoint. Thoughts?

If I were the judge, I’d throw out all charges................
If nothing else, they should try for jury nullification. If I was seated on that jury, I would vehemently disagree with the charges and not vote to acquit on the grounds that these men could’ve been hunting for their own subsistence.
I believe deer are considered public property and can only be hunted with a license.
Cattle and horses are considered private property.
I believe the state game laws deal with this issue.
Whether needed subsistence or not, the land and everything on it belongs to the owner.........

Most states require a special depredation license for this.
One bean field farmer created a scandal when he shot several hundred deer in one year out of season with one of these licenses.

I feel the same way to a degree. But the laws were originally passed to allow over hunted species to recover. Deer are no longer over hunted. Turkey are no longer over hunted. In some states rabbits are in short supply. In Alabama feral hogs are open season year round. As a hunter I do believe that wildlife management is a positive thing as we have a healthy population of deer, turkey, and rabbits. But I do believe that you can harvest deer and rabbits on your own property during daylight hours for sustenance. But these dudes were poachers in most any state due to the lights and the darkness. As a hunting convesationist who has had to stop these types on my land, I think they should be busted. There are also health and reproduction of the population reasons not to hunt in the spring. Trust me when I say without seasons, rules such as daylight, and game management, there are enough clowns like these 3 to damage the populations of many species to the point there would be now legal hunting for years.
I will repeat a comment I just made with this question first. Do you live in an area that has a lot of new human development? If you do the herd may need a cull hunt or two per year. LOL. They are crafty little beggars. It is easier to kill one with your car than with a gun. Lucky for me I see them early enough to avoid them when I’m in my truck. I see them early enough to shoot them and put them in my freezer. Hunting at night is poaching. I do not support poaching.
I hit a deer on I-70 outside Kansas City, Kansas in September 1974 at night about 20 miles from nowhere. Demolished the whole front end of my car, as I was doing about 70 at the time.............The Highway Patrol officer put the deer in his trunk.......
