Massive counterclaims, in excess of $10 million, have just been filed against climate scientist Michael Mann after lawyers affirmed that the former golden boy of global warming alarmism had sensationally failed in his exasperating three-year bid to sue skeptic Canadian climatologist, Tim Ball. Door now wide open for criminal investigation into Climategate conspiracy.Mann arrest photo
Buoyed by Dr Ball's successes, journalist and free-speech defender, Mark Steyn has promptly decided to likewise countersue Michael Mann for $10 million in response to a similar SLAPP suit filed by the litigious professor from Penn. State University against not just Steyn, but also the National Review, the Competitive Enterprise Institute and Rand Simberg. Ball's countersuit against Mann seeks "exemplary and punitive damages. " Bishop Hill blog is running extracts of Steyn's counterclaim, plus link.
Manns chief undoing in all such lawsuits is highlighted in a quote in Steyns latest counterclaim:
Plaintiff continues to evade the one action that might definitively establish its [his sciences] respectability - by objecting, in the courts of Virginia, British Columbia and elsewhere, to the release of his research in this field. See Cuccinelli vs Rectors and Visitors of the University of Virginia...
At last, after 3 years of legal wrangling, it is made clear why I was so bold as to formally undertake an indemnity to fully compensate Dr Ball for my own actions in the event Mann won the case. Respected Aussie climate commentator, Jo Nova was one of the few to commend my unparalled commitment to Ball's cause.
Steyns legal team, aware of the latest developments from Vancouver, have correctly adduced that Ball has effectively defeated Mann after the Penn. State pretenders preposterous and inactive lawsuit against Ball was rendered dormant for failure to prosecute. Under law, Manns prevarications, all his countless fudging and evasiveness in the matter, establishes compelling evidence that his motive was not to prove Ball had defamed him, but more likely a cynical attempt to silence fair and honest public criticism on a pressing and contentious government policy issue.
The fact Mann refused to disclose his hockey stick graph metadata in the British Columbia Supreme Court, as he is required to do under Canadian civil rules of procedure, constituted a fatal omission to comply, rendering his lawsuit unwinnable. As such, Dr Ball, by default, has substantiated his now famous assertion that Mann belongs "in the state pen, not Penn. State." In short, Mann failed to show he did not fake his tree ring proxy data for the past 1,000 years, so Balls assessment stands as fair comment. Moreover, many hundreds of papers in the field of paleoclimate temperature reconstructions that cite Manns work are likewise tainted, heaping more misery on the discredited UNs Intergovernmental Panel for Climate Change (IPCC) which has a knack of relying on such sub prime science.
Where Do We Go From Here?
(Continued at site)
It will be interesting to watch
Crossing my fingers that this is not going to be a situation like that. BILLIONS of taxpayer dollars have been spent on the false premise of "Global Warming." This is a blood in the water moment in the "Global Warming" hoax. There have to be a LOT of lawyers looking at this now to see who they can sue.
Plaintiff Michael Mann is a widely known figure in the
scientific and public policy spheres of global warming
research who has thrust himself into the politics of the
global warming debate by appearing in TV commercials for
political candidates, writing newspaper columns regularly
for The Guardian, The New York Times and others, serving as
scientific advisor to and appearing in a climate-change TV
series starring climate experts Matt Damon and Jessica Alba,
and is therefore a public figure. In March 2012, Plaintiff
published a book called The Hockey Stick And The Climate
Wars: Dispatches From The Front Lines, the front lines
presumably referring to his media appearances with Miss Alba
et al.
lol!
If Mann loses, does that give all of us standing to sue the damned companies that have been feeding at the government trough to build windmills, batteries, solar plants, algae farms, etc., etc.? We have suffered the theft by government of hundreds of billions of OUR dollars to chase chimera supported by falsified data.
I like that!
M&M melts in Canada in February. Who Knew? Must be a global warming thing.
LOL!!!!
Great point. One can hope, but then again we have seen how hope works with Obozo.
Can we finally get Steyn back to his Saturday NRO column? Was always a great way to start the weekend
Mann should produce his data for open interpretation and if it is found to be faked he should be tried for fraud in US federal court as he received government money to perpetrate his fraud. Too bad All Gore can’t be sued for his fraud.
Now that's too funny for words!!!!
To all- please ping me to Canadian topics.
Canada Ping!
Mark Steyn vs Michael Mann of glow-bull warming infamy.
It would be sweet to hear major colleges and businesses come out and issue apologies to the public for relying on information which has turned out to be fraudulent. Won't happen though will it.
Algore and the others made their money using Mann as their monkey boy. Now that he no longer serves a purpose, they are discarding him. Liberal loyalty.
Very true, a lesson relearnt today. But, you can't consider yourself the world's best at hockey sticks if you haven't been up against Canadian hockey sticks.
The Great Profit of Global Climate Doomism, the Grand Poobah, Al Gore, made much and many millions on a known scam.
He should be yanked up by his short and curlies and subjected to the full weight of criminal law covering such things.
Thanks for the ping!
Gonna spread this around and see how many heads I can get to go POP!
