What began as a simple traffic stop ended in a humiliating and nightmarish ordeal for a New Mexico man. It wont come as a surprise to most people why the man has now filed a federal civil rights lawsuit.
The incident began on Jan. 2 as David Eckert was leaving the local Walmart in Deming, N.M. He reportedly failed to make a complete stop at a stop sign, prompting police to pull him over.
The officers asked him to step out of the vehicle and claim the man appeared to be clenching his buttocks, Eckerts attorney, Shannon Kennedy, told TheBlaze. It is unclear why police removed him from the vehicle in the first place. However, because the cops believed he was clenching his buttocks, they took it as reason to suspect him of hiding narcotics in his anal cavity. Police officers detained Eckert while they sought a search warrant for an anal cavity search.
What is so strange about this case is they held him with no evidence, Kennedy said. They seized him to collect evidence, to go on a fishing expedition on someones body.
Upon securing the warrant, Deming police officers took the man to an emergency room, but hit their first snag when a doctor refused to perform the anal cavity search because he believed it to be unethical.
So police tried again at the Gila Regional Medical Center in Silver City, N.M., where doctors agreed to the search.
KOB-TV outlined the disturbing series of events that occurred next, details confirmed by medical records and official documents provided to TheBlaze by Eckerts attorney:
1. Eckerts abdominal area was X-rayed; no narcotics were found.
2. Doctors then performed an exam of Eckerts anus with their fingers; no narcotics were found.

Good grief! The hospital billed him for the rectal exams, enemas and colonoscopy.
And I would imagine most people in NM would not mind this at all. People there are socialist-minded.
This is a truly unbelievable story. I don’t understand why he did not get a lawyer while he was at the hospital. I mean, it astonishes me that they could do all this without placing you under arrest.
Wait until Obamacare kicks in.
He’s actually quite lucky. In some states, the LEOs would simply have planted the evidence to cover their screwup.

See item #22, defendant Rodriquez told him he was free to go before defendant Rodriquez was offend by him asking if he was indeed free to go when defendant Rodriquez continued to question him after releasing him.

Remember those folks way back when... the ones who were mocked and derided for claiming that they had been abducted by aliens (complete with probes and medical procedures)? Looks like they had received visions of the future!!!
If I was Mr. Eckert, every one of those people would be BEGGING for me to file a lawsuit for $500 million instead of taking my preferred course of action.
While the police with the help of the doctors certainly went way to far searching this guys backside, there is more to this story.
1) Police k9 unit detected drugs on the drivers side giving the judge reason enough to justify the search warrant.
2) Eckert had a criminal history of hiding drugs up his bum, he’s no saint.
That said, after the first examination it became “unreasonable”.
It also says the complainant at some point stopped answering them. Nothing will piss off a narcissist on a power trip quite like exercising first and fourth amendments simultaneously.
Another factor, these cops are paid hourly. I wonder how much OT these idiots accrued driving all over New Mexico with the perp in back?
Last factor. Police chief in his statement defended the officers actions (probably on advice of city council). In doing so, regardless of the financial interests of the city and county he is abrogating his responsibility to his job, the law, and the Constitution. All the chief did was give the cops the Nuremberg defense probably again on advice of council.
I think the biggest danger is to imagine the incident to be isolated. My guess is this kind of thing happens all over the country, but usually to the very poor who can’t afford to do anything about it.
Did anyone ever think that maybe the guy needed to take a dump?
We almost have lost America.
Also prosecute them criminally. This is sexual assault under color of authority. People need to go to prison.
The scary part is there are some folks right here on Free Republic that would find this OK since its part of the war on drugs and all.

Reading this makes me so angry, but I also wonder If there is another side to the story. I try not to have knee jerk reactions to these kind of stories. Also, perhaps the officer hone this guy from before and was enjoying some payback.

I just now read about it on WND, then came to FR to see if anything had been posted.
This news just blows my mind, but confirms what I witnessed just before leaving the USSA. Cops have morphed into jack-booted thugs.
