Your vision is clouded. I dare say the girl probably emerged from between two cars or such. If the driver was operating at/under speed limit how is he at fault?

She’s still have her “daddy” (my my, your posts are certainly dripping with emotionalism!) if her “daddy” controlled her behavior, had her in bed at a proper hour for a four year old, didn’t let her run into the middle of the street late at night, and had not attacked the LEO who first of all tried to avoid hitting her, and then was giving her some kind of first aid.

The evidence is the four year old child.

If one is properly observing *all* the rules of the road, one will *not* hit pedestrians crossing the street. Period.

Exactly, it is incumbent on every motorist, regardless of vehicle, to be always aware when driving.

So no child is struck by anyone.

Cop should've flipped it to avoid the kid. The bike stops right there when the only thing you're using to stop it is the front brake.

Yeah, tell that to the guy who hit and killed a little kid who ran out from behind a hedgerow in my hometown.

He was not speeding, he was not impared, and he still hit and killed the kid.

No charges were filed.

Again offer proof he was speeding, or shut up.

The same way any driver, regardless of occupation, would be held at fault for hitting a child in a vehicular accident.

Why? The adult, not the child, is responsible for observing the rules of the road and *not hitting the child in the first place*.

And you did not address even one of the valid points I made.

You are the reason I hate the internet.

Read the articles, it was an accident. Period.
He was being punched and kicked.
Feared for his life and defended it.

Many kids and animals are hit every day by people observing every law of the road to the letter. Its called an accident.

Sure as hell i’d be mad if a cop hit my kid, but my reaction would be to attend to my child.

“Not speeding” does not automatically mean “was traveling at safe speed for the conditions”, as your example reminds us.

You seem to believe that going 28 in a 30 and still hitting a child or 33 in a 35 while hitting a child is acceptable.
