So I saw this deal on a nice car on an Automotive enthusist's website. The car was in California, I am in Minnesota.
I agree to buy the car, fly down 1-way, check out the car and do the following:
- Write up a purchase agreement for the amount (I have a copy).
- Give him a Bank Cashier's Check for the full amount (I have a copy).
- We go to the DMV in Ca., do all the paperwork and I drive home to Mn. (I have a copy).
Now the problem....
Minnesota says the car is much more than what I payed for it... like $5,000 more. (Well, NO KIDDING, it was a deal, that's why I went to that extent to get it!)
Minnesota will not give me the clear title for the car until I pay several hundred more.
Can they really do this?
Isn't there some Commerce Clause?
I payed in full for the transaction and the transaction is complete!!
This was a YEAR ago and I do not want to give them more money if not necessary!
More info: I payed Ca. Tax on the vehicle for that sale price.
Now, Mn. wants to charge me 7.5% on the difference on what I payed for it and what their books say it’s worth.
Geez.
Yep, sounds about right. Most states are not obligated to accept the purchase price as the value of the car for tax purposes. This prevents cash (or partial cash transactions) to avoid sales tax.
Yep. Shouldn’t have paid CA tax since you don’t live there. As to the value, they are the govt and that is life.
I’ve known of a couple of cases like that over my life. Generally, some states (limited number)...have a law they put into effect that guarantees the pricing at or near the Blue-Book price. It’s a protective practice because they know that some guys arrange a deal where they pay $1k less on the book price but slip the $1k under the table with no receipt. So the state is merely protecting itself on getting what they perceive as “their fair share”.
I would suspect, unless you can show damage or a reason why the pricing was under the Blue-Book value....they’ve got you.
Ca. made me pay tax there when doing the transaction...
The clerk said "That sounds too cheap". I told her the transmission was in a box in the trunk in about a hundred pieces, and that was the end of that conversation.
Anytime you go register a vehicle in whatever state, they have the price of each vehicle and the tax levied against it...good thing you got a deal out in CA - because it looks like you’ll break even now that you are back in MN...I’ve encountered the same thing in different states I have lived in - and yes - the value of the car can raise or lower the registration and taxes...
If you had been a member of a MN militia group - you wouldn’t have paid any taxes ( well, they just don’t pay them!)
The land under your feet, the roof over your head, food on the table, clothes on your kids are all distant, secondary, irrelevant needs in comparison to the demands of the state.
Once the serfs learn this, it all makes sense.
Are you a minority ? If you are just tell the state obama will pay
If not, just pay and send them a little extra to pay your white guilt penalty
Sorry to hear it frbuddy, but IMHO you’re f***ed. Greedy armed robbers is the definition of government.
We have the same thing in CT. They do have a form you can fill out to get a rebate. They make you jump through hoops cut you can still get it. Might ask about that in MN.
MA does the same thing, there might be an appeal process in cases where the car is a wreck or in bad shape.
You should be able to write off the sales tax, FWIW.
52 year old White Male, who just wants to enjoy a nice GTO = Guilty. $#!}
The only thing I think I can do is go to auto shops and get quotes for things it could need and submit it.
I’m so pissed.
What a SCAM! I PAID Tax on what I purchased and have the proof!!
Same deal in Texas. Try going to a professional title service, they maybe able to get the car titled at what your paid. Ask 1st of of course.

Remove something expensive, then take it (or have it towed) in and get a quote to replace it. Make sure they quote you the price for an OEM part.
Go to a local friendly mechanic that will do a thorough assessment of every thing that is wrong with the car, that will add up to $5000 in repairs. Bring that into the DMV with you and go to the supervisor not the flunky at the counter. If that doesnt work put a call into your state reps office, so they can make a call. ( that is what they are there for) generally managers do not like calls coming in from the people that fund their department. If that doesnt work, find a friendly consumer media station in your area to do the story. Keep cranking it up. Then find where that person lives..... then....
Standard practice, my man, standard practice.
Moved from MA to Maryland a few years back ... excise taxed twice ... $900
