MALIBU (CBSLA.com) — A transient was arrested Wednesday evening after allegedly killing a pelican with his bare hands.

Sergio Alvarez, 30, is facing felony animal cruelty charges and is being held on $20,000 bail, Los Angeles County Sheriff’s Department said.

While on patrol around 5:50 p.m. Wednesday, a deputy was flagged down by a witness near the Malibu Pier in the 23000 block of Pacific Coast Highway, officials said.

The witness said Alvarez had a pelican by its throat and was choking with both hands.

“Witnesses told deputies the pelican flapped its wings in distress until its body went limp and died,” Lt. Robert Wiard said.

Alvarez, who is known to frequent the Malibu Pier area, was arrested.

“He said he was hungry. And he found the bird dead and was going to eat it,” sheriff’s Sgt. Michael Holland.

Personnel from the California Wildlife Center took possession of the dead pelican.

He should have gotten a hunting license. The man killed his food and is now facing felony charges for taking action on his own behalf to survive?

Why a pelican? They are easier to catch than rats.

Why does this story remind me of Christine Odonnel?

The Brown Pelicans on the Texas Coast are very big powerful birds. I would never want to mess with one of those.

There has to be more to the story.

Boudreaux was in trouble for shooting illegal game.
The judge said, "Boudreaux, don't you know the Pelican is our state bird? And you can't go around shooting it?"
Boudreaux said, "I didn't know dat."
The judge said, "Okay since you didn't know it, I'll let you off with a warning this time. By the way, what's pelican taste like?"
"Oh, pelican is delicious, but it's not as tender and juicy as a bald eagle."

So, the game warden is walking down the beach and sees a guy roasting up a seagull on an open fire. He walks up to the guy and explains to hims that it is illegal to kill a seagull much less bbq it up.

The guy gives the game warden a sob story about being destitute and close to death from starvation and he came across a dying seagull and figured that, since it was gonna die anyway, it would be ok to put it out of its misery and eat it.

The game warden took compassion on the guy but gave him a stern warning to never do it again. The guy said ok. The warden bid him farewell and turned to walk away, but at the last minute his curiosity got the best of him and he asked the guy, “I’ve always wondered. What does seagull taste like?”

The man thought for a moment and finally said, “Well, it’s sort of a cross between spotted owl and bald eagle.”

The sad/funny thing in all this is that in Kalifornia he’ll probably due more time for killing a pelican than a human.

I think he still would have been in trouble had he had a hunting license. I believe pelicans are protected...

The pelicans, of course, dive down from above and scoop up protesting fishing into their beak sack thing. But that’s ok!

$20,000, what insanity.

I hope he spends ten years in prison. I live in a city where there’s Canadian geese and ducks who enjoy a pond in the middle of a giant metropolis. They’re protected in the sense it’s illegal to kill or shoot them. But there’s always the drunks and scum of the earth who, for no apparent reason, attack and kill them. There’s been a couple of instances where they’ve been attacked and where I (with quite a bit of fear and trepidation)have tried to stop it.
I’m proud of that.

I hate those damn illegal immigrants. I live on a lake. They rip the siding off your house. They e-coli the lake. They crap all over the beaches and docks. And don't even get me started with those tree rats that city folk call "cute squirrels".
