You can't be charged or taxed for NOT buying something.
Period.
Being alive is not taxable. It can have no conditions applied to it. It was endowed by the creator, not by the government. If you are healthy or if you are sick, government can set no conditions on you. All men are created equal by God, it is not governments role to treat them unequally depending on if they do this or do that or don’t do that.
This is basic law, this is the fundamental law of the United States of America.
It is recognized as such by being listed as part of the Organic laws of The United States in Volume 1, Page 1 of The United States Statutes at Large.

People have trouble understanding that RIGHTS ARE ABSOLUTE!

And the vast majority of them, when they say “Gimmee” to the government, they are asking for privileges and benefits and exemptions and credits, they are not demanding that government protects their rights.

The Constitution calls itself “the supreme law”, but historically, that is probably incorrect.
The United States Statutes at Large Vol 1 starts with the Declaration of Independence.
The next entry is the Articles of Confederation.
Then, finally, the Constitution of the united States.
It might be argued that the Articles (which were NEVER repealed) are supreme over the Constitution (which came later), but it can NEVER be argued that either the Constitution or the Articles are “supreme” over the Declaration of Independence.
We are bombarded with babble, meaningless flighty confetti and told it is information. The signal to noise ratio is at an all-time low in the media, and people are not well enough educated to determine which is which.
When the word 'discriminate' became an evil (with the exception of good metal detectors) people became less discriminating, abandoning the determination of what was good in their confusion over prejudice and discrimination--the two of which were conflated to mean "racist", something no decent person would want to be.
It is time to retire the race card, too, but in other matters, discriminating between crap and valuable data needs to be revived.

George did know that law/government is force. Just look at the Whiskey Rebellion.
The District of Criminals unilaterally imposed a tax on whiskey to pay off the debt of the Revolutionary War. The reasonably intelligent citizens knew that the war against the British was over taxes and rebelled against DC acting just like jolly old England. George sends in the troops in to quash it and everyone flees. Problem solved!
We must be still paying off the debt from that war because taxes on alcohol are still in effect. Is anyone complaining? Nope.
And people wonder how we got from the tax on whiskey to the tax on breathing via ObamaCare!
Well, now it is. Simple existence will cost you around $3000/year unless certain qualifying deductions are demonstrated.
Could be interesting to attack this as an improper extension of the struck-down "poll tax".
Oh, plenty are complaining. Bootleg liquor still exists, and some sacrifice themselves over the principle (a moonshiner produced an extensive video how-to guide, now on YouTube, knowing he would not be long for this world, and wasn't).
Just because you don't hear the complaints doesn't mean people aren't complaining. "By right of conquest" resolved the issue insofar as it is tolerated with frequent objections.

The question should be one of why should we collect the money. Should the government be doing these things in the first place?
The answer is almost universally "NO."
The less Government does, the more the private sector can accomplish, partly because the capital to accomplish it will be left intact.
It is within the ability of Congress to levy excise taxes on goods. However, NOT buying health care is not a 'good' to levy a tax on. Recall it took a Constitutional Amendment to permit Congress to tax 'income', and note the taxing power of Congress is limited. Where are the pundits on this?
As a penalty it is illegal (ICC), as a tax, it is too.
While the Whiskey Rebellion may have been put down to collect a tax on something, the Revolution would have been fought again if the Government had tried to tax not doing something.
In the meantime, while people may not be complaining, there are still stills in the hills, and the 'A' in BATFE.
As for taxing Rights, it has been done since the NFA of '34. Quibble as you might, the transfer "tax" is levied on any legal class III firearm.

In principle, however, the individual is supposed to be secure in their unalienable rights to life, liberty, and property, and the stinking government should keep its grubby meathooks out of all three.
I fully agree with you on what limits are placed on the Feds and States and using that as a measuring stick to determine whether what they are doing is legal or not based on the black and white of what is in the Constitution and its Amendments and the writings on them by the Founding Fathers.
Even though Americans were upset with the whiskey tax imposed by DC it was still legal since it was an sales/excise tax.
At one time in America the fruits from a man’s labor could not be taxed. But it was then re-defined as “income” and thus taxable. At one time you could not tax a man’s property. Look at how common property taxes are today. Where are the pundits on these? I think ND had a measure on their ballot recently to vote property taxes out of existence but it failed.
There was a telecom tax that dated back to 1898 to help fund the Spanish-American War. It wasn’t repealed until 2006.
But like you mentioned all of the above taxes were imposed on a human activity and not the lack thereof which is what collectivist deathcare is going to do.
With our massive debt going asymptotic I don’t think the thugs in business suits in DC are going to repeal this act. As a result I predict that there is going to be a simple outright rebellion against the Feds and the States that implement this due to the failing economy and for being the largest tax increase in our country’s history for inactivity as you subtly hinted in your post.
And it doesn’t matter if Obama or Romney gets in office because both are Progressives who love to tax. RomneyCare imposes a tax and so does ObamaCare. Those in the House and Senate are not going to do it either. If people honestly believe that Romney or Congress is going to work to repeal it I multiple bridges to sell them.
With our debt progressing at a geometric rate no amount of taxes confiscated can feed the beast enough to satisfy it.
We did. It was defeated by a slick media campaign funded by special interest groups (only about $1800.00 of a half million they had was in contributions of $100.00 or less) under the banner of "Keep it Local ND". About half of the special interests were national groups including the NEA and the AARP.
The grassroots groups fighting for the measure could not muster the war chest to overcome the mass-marketed misinformation campaign. The issue is far from dead, however. Now that it has been brought up, it won't go away.
