Thinking out loud here, but am I now being taxed for breathing as an american citizen if I don't have health insurance?
Correctamundo.
So yes, Congress can tax anything.
Unclear. If you didn’t work and don’t need to file taxes, does this mean everyone will have to file to comply with ObamaCare provisions?
I read somewhere that America is the only country that claims ownership of its citizens no matter where they live or for how long they’re out of the country. Last year there was a story in the British press of people who were born in America but moved to England or Canada as a baby or very young child and suddenly received a bill from the IRS. So this SCOTUS decision confirms ownership, serfdom, if you will.
>> If you didnt work and dont need to file taxes, does this mean everyone will have to file to comply with ObamaCare provisions?
heh...
LET THE GAMING OF THE SYSTEM BEGIN!!!
I wonder if the Obama-Pelosi-Reid-Roberts axis is half as smart as they believe themselves to be.
It also hasn't been litigated in the courts. The case isn't ripe until 2014, when the first tax bills come due. Until then, no court action can happen. Somebody has to pay before anybody has any standing. I wouldn't be surprised to see the whole law tossed out then because it's a poll tax.
Nope, the SCOTUS majority said that the mandate was not a tax for purposes of the Anti-Injunction Act, so that challenges to it were ripe now. It then went on to hold that it was a tax for purposes of the Constitution, and upheld it as not being a "direct tax."
The 24th Amendment doesn't come into play here, because not paying the penalty doesn't take away your right to vote.
So, then not paying means that I can vote in jail?
It is not for the SCOTUS to set taxes, or even determine which taxes are just. That is the job of the people and their elected representatives. Congress hoped (AGAIN) that the SCOTUS would clean up their disaster, and yet again, the high court said ‘nope, this is your mess, have fun. Oh, and stop lying, it’s a tax.’
The SCOTUS has done a bang up job this week putting out good rulings.
The ruling today said the government can tax you for absolutely any reason they want. They do not have to be fair or objective or apply those taxes equally. They have an unlimited and unfettered right to use the tax system to enslave you. And make no mistake some of us in this country are slaves and some are not and it has been that way for some time most especially since the implementation of the welfare state.
They can tax you to murder the unborn children of strangers, to breathe, to vote, to go to the movies. Hell they can tax you if you choose not to see a certain movie.
Roberts can try to use the governments power to tax as a way to excuse his choices, but the truth is he knows very well this is not what that clause was meant for. This is nothing more than slavery and it is time we stepped up and limited the governments power to tax us into a slave nation.
I don’t see how any liberal watching Roberts up and side with them can construe it as a good omen for them.
It’s a tarp.
Doesn't not paying that tax qualify as a felony? If so, then not paying does take away the privilege of voting.
Eventually it was shredded by the SCOTUS, but the temporary deviation from the constitution was required to keep the SCOTUS from becoming the ultimate member of Congress. They can NOT do the job of Congress - theirs is the job of protecting the constitution.
In ObamaCare, in the rush to get ‘that last vote’, the liberals just walked square into it. Roberts finally found a limit to the commerce clause - a chain that up until now was infinite. And for a bit of icing, ObamaCare got called what it was, the biggest tax increase in history.
Taxation is in the power of Congress. They could (and have in the past) create top tax rates to seize virtually every penny someone earns. That is an undisputed right, and it isn't within the SCOTUS’ power to restrict that right. That is held by The People, through their representatives.
Can Congress tax your right to prayer? No. Tax your ability to vote? No. Tax your speech? No. But they sure can tax anything they aren't restricted from.
So, yeah, the liberals on the court couldn't wait to let the Chief Justice Roberts write the most important opinion in recent history, and possibly one which will limit the federal government for generations to come, so long as their political goal was kept in sight - that of keeping whatever the liberals want to do alive.
They got it; the ultimate atomic bomb in American politics - you just raised the taxes on the people who actually get up and vote. Good luck with that.
Death Panel Tax, at that!
there has been no fundamental right to life since Roe v. Wade
No. If it's a crime at all, it's a misdemeanor.
If so, then not paying does take away the privilege of voting.
Not every state takes away the right to vote for criminal convictions. Besides, by that reasoning, *every* tax is an unconstitutional poll tax.
