A Glorieta family woke up Friday without Jilly.
The family's 11-year-old dog was shot and killed Thursday by a New Mexico State Police officer who was on the family's property.
The department tells our media partners at KOB-TV that it will investigate the incident, but initially sees no cause for disciplinary action. KOB-TV did not indicate whether the officer's name was made public.
"Was there things that could have done different? Absolutely, however that's the situation that occurred and so now we'll deal with it," Lt. Robert McDonald said.
Victoria Baca on Thursday morning called police to file a report about an internet scam she recently fell victim to. State Police could not come immediately, so Baca went to run errands with her young children and asked that she be called when the officer was on the way so she could meet the officer at the home.
The officer, she says, went to her home and never called. The officer hopped the fence to her property a fence with a clearly posted "Beware of Dog" sign and says one of two dogs Baca had on the property bit him. The officer shot and killed Jilly.
State police said the officer thought Baca was home and entered her property.
Police called Baca after the shooting and when she and her children arrived home, Jilly was dead on the front porch of their home.
"My 4-year-old's response was, 'Did they shoot our dog?'" Baca said. "My son walked up the stairs and started shaking her, trying to wake her up."
Baca said she plans to hire an attorney.
"I called for help and instead I ended up with the loss of a family member," Baca said.
McDonald told KOB-TV it appears the officer was only acting in self defense and he said the department apologizes to the family for the tragic event.
"It's too late for an apology," Baca told KOB-TV. "She's gone, an apology isn't going to bring her back."

That’s probably a sad fact.
Out here in the boonies, the local yokels are all farm boys who grew up with dogs of their own and hillbilly neighbors who always had at least 2 or 3 porch dogs running loose.
I’ve *never* heard of a single one of them shooting a dog.
They “know how we are” and unless they heard somebody screaming bloody murder, they’d never just stomp onto your land uninvited.

Many years ago the psycho up the hill from me dumped what appeared to be antifreeze in my back yard.
One of my dogs alerted to me to it before the other dogs could get near it.
When the county sheriff got here to check it out, he sat in his car in my lane and called me from his phone to let me to know he was outside, waiting to be let in.
I didn’t know this particular sheriff but he was very concerned and asked me if all of my dogs were okay.
That’s how it’s done.

Then, after that incident, there will be another in a totally different State. This will be about the killing of a favored pet in a situation that is totally unjustified. The owner of the pet, in a rush of rage and a flush of emotion, will react in a manner that can best be described as 'murderous.' The owner will not survive, but like the first case he will go down with his own 'butcher's bill.' This will also lead to a change of protocol in regards to treatment of private property (whether private property is one's home, or one's dog) and the circumstances that give a LEO justification in engaging in certain action.
Someday. Soon. It is not a wish (I wouldn't wish for anyone to be harmed, be he/she civilian or LEO, and I believe the vast majority of LEOs do real good under hard circumstances and little recognition) ...it is just plain mathematics. Permutations and probabilities, and the likelihood of an event occurring based on the current trajectory of certain precursor events. What is a surprise is that there hasn't been a dynamic entry yet to the 'wrong' house (wrong as in an innocent civilian who knows his way around personal defense) or kill the wrong dog (such as the case when some perps killed the dog of a former SEAL who chased them for miles in a highspeed chase at night). It is a matter of mathematics ...and if I was the Chief of a PD I would be a little worried since it appears, so far, LEOs have been tossing straight Heads with no Tails for years now. Sooner or later they will bump into the wrong civilian. Sooner or later.

Yep. You would`ve been tased and the dog shot dead on the spot. Then they would start asking questions.

And there in lies my benchmark for all such situations. Why hasn't the cop been arrested? I want an answer that is better than, "Well, things could have been done better, but they weren't, so deal with it."
I spend a lot of time on another site. It’s a gun forum that has many cops as members and as moderators.
Every one of these shootings gets discussed. The pretzels that the cops will twist themselves into to justify and defend a “fellow” officer who they have never met would amaze you.
The non-cop members generally receive the punishment when the discussions get heated, to the point that someone often posts at the beginning of these type threads a prediction of how many warnings, locks, and bans will be issued by the mods there.
It has truly become “us vs. them.

The dog *was* 11 years old and you know what they say about the elderly.
They’ve not got long to live and have nothing to lose...that makes them much more dangerous.

I will never, ever, call the cops if at all possible. I will do everything to avoid any involvement with them. They are not to be trusted.

sounds impossible, but i knew him and had a hunting buddy who worked with him also in the whp, his nicname with the other patrolmen was “psycho” i kid you not
i was living outside of rawlins and Psycho’s wife worked at a truck stop, she was fired for money continually missing when she was working...turns out she was trying to get funds to leave him
she disappeared and he quit his job to go look for her, thought she might have run away to michigan or something
this guy harassed me because he thought i had something to do with his wife disappearing, if i hadn’t had a friend on the WHP to call it could have gotten real serious...the crazy guy even gave me a ticket for my truck being parked in my own driveway, saying it was blocking traffic...gave it to my friend on the WHP and he said it was an old style of ticket they didnt use any more and they used it for scratch paper at headquarters
another instance he got into and argument with a truck driver at the truck stop where his wife worked and he drew his 9mm and ordered the guy to get in his truck and get on the highway...which the guy did, the whole time under the barrel of Psycho’s gun...when Psycho holstered his weapon, he turned around and saw a half dozen people watching in shock, and he laughed it off and said “i don’t think my 9mm would have penetrated his cab anyway, i should have brought my .357”
i know you’re all thinking this is bs, but it gets worse
out there in WY they give WHP free housing so they’ll be kind of spaced out along the highways in case they get called out of bed for an emergency on the road, there’s always an officer nearby...after Psycho quit his job to go hunt for his wife, a state employee went into his state-provided house to inspect it and get it ready for the officer who would replace him, and he reported that he could either fix up the house, or bulldoze it and replace it with a doublewide trailer, the cost would be about the same
Psycho was a TKD black belt and he’d punched or kicked holes in the walls everywhere, there were bullet holes in the walls and ceiling, the place was a pigsty and here’s the kicker...the doors on the bedrooms had lock hasps and bars over the windows like he was locking his wife and kids in at night
i know there’s freepers here that post from WY, this is the mid 1990’s I’m talking about, there aren’t more than a dozen WHP assigned in that area, i’m sure ever WHP there remembers him or has heard the story...can’t remember his real name
after he’d been gone a while i asked my hunting buddy if they ever heard what happened to him, he said that Psycho didn’t find his wife (thank God) and was working in Michigan as a security guard in a Kmart
i told him i ought to call the store there, ask them to get Psycho on the phone, because i wanted to ask him what the “blue light special” was...and my buddy got all cop right away and said “YOU WILL NOT.”
the point is, that’s about as bad as it gets...and whenever i or anybody else wanted to make a formal complaint, his buddy officers alwayssaid they’d take care of it, please don’t make a stink, and covered up for him every time he screwed up, and he really WAS a ticking time bomb...i don’t know how many times one or another of them said they expected any time to hear he’d gone berserk and started killing everybody
anyway, i know people will think this is bs, so if there’s anyone in the WHP or who knows WHP in south-central WY that feels like giving a shout out, maybe you’ll update this crazy post...it’s as true as i can write it, so help me
