A Glorieta family woke up Friday without Jilly.
The family's 11-year-old dog was shot and killed Thursday by a New Mexico State Police officer who was on the family's property.
The department tells our media partners at KOB-TV that it will investigate the incident, but initially sees no cause for disciplinary action. KOB-TV did not indicate whether the officer's name was made public.
"Was there things that could have done different? Absolutely, however that's the situation that occurred and so now we'll deal with it," Lt. Robert McDonald said.
Victoria Baca on Thursday morning called police to file a report about an internet scam she recently fell victim to. State Police could not come immediately, so Baca went to run errands with her young children and asked that she be called when the officer was on the way so she could meet the officer at the home.
The officer, she says, went to her home and never called. The officer hopped the fence to her property a fence with a clearly posted "Beware of Dog" sign and says one of two dogs Baca had on the property bit him. The officer shot and killed Jilly.
State police said the officer thought Baca was home and entered her property.
Police called Baca after the shooting and when she and her children arrived home, Jilly was dead on the front porch of their home.
"My 4-year-old's response was, 'Did they shoot our dog?'" Baca said. "My son walked up the stairs and started shaking her, trying to wake her up."
Baca said she plans to hire an attorney.
"I called for help and instead I ended up with the loss of a family member," Baca said.
McDonald told KOB-TV it appears the officer was only acting in self defense and he said the department apologizes to the family for the tragic event.
"It's too late for an apology," Baca told KOB-TV. "She's gone, an apology isn't going to bring her back."

What gave the right for the officer to enter the property without the owner’s permission?
She wasn’t a suspect and she had broken no law.
It’s almost as though cops are looking for dogs to shoot.
Sad story. Ms. Baca probably has never had much dealings with the cops.
She requested that she be notified when they were on the way - unlikely to happen.
She assumed the officer would respond knowing the reason for her call - it could well be that never happened either, given the cop climbed her fence. Maybe the cop thought the caller was in a potentially bad situation. Maybe.
While I can’t blame her for doing so, personally I would never leave aggressive, or for that matter, any, dogs outside even in the back yard, knowing people were on the way over - particularly cops that routinely don’t respect private property.

There was no justification for the cop to trespass, if he truly did not know why he was called to the residence.

I’m allowing for the slightest possibility that the cop didn’t go looking for the dog.
I’d like to think there is always a bit of good in everybody.

About 35 years ago, I had just set the timing on my 71 Chevy,
then I asked an older auto class teacher; “How do they get out of time, after you have just set the timing?”

Why put up a fence around your personal, private property if you don’t expect cops to just hop over it whenever they feel like it?
Can cops be charged with criminal trespass?
If somebody *without* a badge did this, they’d be going to jail.

Everybody knows that an internet scam investigation is always resolved by going onto your property and killing your dog.
I used to believe that if TSHTF, the cops would automatically be on the side of American citizens.
Not any more.
I once got the cops called on me by a neighbor of my sister’s. I was 16, taking care of her dog while sis was on vacation. I forgot the key so went in through the front window that I jimmed open. Let the dog out, put the food in , water, etc.
Was half-way coming out of the window and 2 cruisers were there with a cop waiting for me! (Nice upscale neighborhood).
They just talked to me as I had my hands in the air and I explained what was going on. After they figured I was just a dumb kid they looked in the window, etc. They started to go around back through the gate but the dog was barking his head off.
They asked “Does he bite?” I said “No - but he doesn’t like guys in uniforms.” They laughed.
I’m glad it happened 30+ years ago. Neither me or the dog would have made it today.
We are increasingly becoming a nation with two sets of laws.
One for the Agents of the State.
One for the Slaves of the State.
Some will be—those who have the mindset of peace officers. There are still some remaining, though their number is decreasing.
An increasing number—those who have been trained as LEOs-—are more likely to be on the government’s side.
