So you are saying your and/or your friend feels that Palin will settle out of court for a large sum rather than pursue the case in court (which the lawyer feels she will win) and ALSO clear her name by doing so? Why? Just to save on the lawyers fees for the court case?

I don’t get it.

Your title is misleading. No suit has to be settled. Suits are settled when both sides view a settlement their best NET result.

This suit may be settled if Random House and the dumb author really has given the Palin’s the hammer that it seems. As Mark Levin said tonight, the dumb author has pierced attorney client privilege with which ever attorneys he was referring to in his e-mail. That means the lawyers are open to discovery and testifying under oath. Random House may well try to buy their way out of having their attorneys deposed.

The problem that I see is that our politics have reverted back to a base level that would make the Roman Republic look classy. We are having a internal cold war and it’s about to get hot.

1. It is almost impossible for a public figure to win a defamation lawsuit.

2. Truth is an aboslute defense to defamation. That means that SP and Todd can get deposed about their marital life. Glenn Rice would also be deposed.

Filing a defamation suit would be the worst thing the Palins could do.

It’s not clear that the book has damaged her.

I vote no on suing. Lawsuits take over your life and not in a good way.

Cart before horse. Palin has not sued; her lawyer wrote a letter raising that possibility and giving hard evidence in her favor that would be brought out in the event of a lawsuit. At the very end of the letter he tells them to contact him if they wish to resolve the dispute. The ball is in Random House’s court; they will no doubt make an offer, Palin’s lawyer will review it and negotiations will begin.

Because Palin holds all the cards, a simple apology would be insulting and will no doubt be rejected. Any final settlement involving monetary damages will probably be kept confidential but I expect much more such as public announcements that the book is being withdrawn, a lengthy statement admitting guilt and a confidential monetary settlement.
