Here’s what she needs to play before coming out on the stage, including the FREEDOM cry at 0:28. (Maybe Ted could change a few of the lyrics), however, I’m sure he would be honored to have it as Michele’s theme song!

The Standard Contract for Singer-Songwriters is the Publisher gets half the profits, and the Composer gets the other half. The Right to License belongs to the Publisher, and the funds for the performances are monitored by performance rights organizations such as ASCAP or BMI. DJ’s and Venues (as well as the Artists themselves) pay dues to the performance Rights Companies. Every Bar, Gym, Fitness Club, Nightclub, and theater belong and pay dues, in order that the Publisher and The Artist get paid for their intellectual Property.

Irving Berlin got both slices of the Pie by forming his own Publishing Company, which subscribes to ASCAP. ASCAP has been known to sue the BOY SCOUTS for singing “God Bless America” without a license. After a precedent like that, you can BET that The Republican Party would NOT play a song without first paying for the license.

As to whether or not Petty owns 100% of the rights to his songs, I really don’t know, but if it were the case, he would have to be his own publishing company and have issued and distributed all of his recordings under his own label. Even Bob Dylan wasn’t smart enough to do THAT! LOL.

Petty dictated the cease and desist letter himself which read: “Heh, muhhinnah heh. Essa beh. Bebuddah heh.”

I always loved the Saturday Night Live impressions of him (Dana Carvey?). They nailed how you totally cannot understand a word he sings. The skit with him and Bob Dylan having a conversation was classic.

Bachmann’s better off without him.

Honestly if she was paying attention to the lyrics she wouldn’t want to use the song anyway. Nothing good is happening to the American Girl in the song. This is another one of those Born in the USA situations, somebody likes one line, doesn’t bother to pay attention to anything else and thinks they’ve got themselves a great anthem.

And why do campaign’s need theme songs anyway? I mean I know it’s all theater, but you don’t have to admit it’s all theater.

Tom Petty can’t prevent her using that song, its a commercial item,, all she has to do is pay for its usage in usual royalty payments.

Maybe she can get Iced Earth to play “The Reckoning”. If you want to see patriotic tea party pounding metal look up iced earth on youtube.

Two songs. The reckoning and also look up their gettysburg song.

They rock. Bachmann can also use Seek and Destroy from Metallica too. That would be awesome.

Thanks for the info.

I was a freshman in college when Full Moon Fever came out and we listened to that CD (yes, I bought it on CD in 1989) a bunch, so I've always been a fan.

It doesn't bother me if he doesn't want his music played by Bachman. It does bother me if he doesn't have the legal right to stop it. If he sold his soul, he should shut up and deal with selling out his integrity.

Depends on if Petty sold his “children”for “adoption” though, doesn't it? If the label owns the rights, fair use says he has no argument, and he should let the legal parents of his music raise his “kids”. He can rant and rave all he wants, but he already sold his “kids” to another “parent”, if that is the case.

If ‘one-sheet’ TP owns the rights to publishing, he can do as he sees fit. If he does not she can buy the rights from whoever does, play it according to the terms she bought usage rights for and he can bitch till the cows come home.

It comes down to who owns the rights.
