Levin makes an interesting point that the Federal Judge today declined to issue an injunction because he didn’t need to. ObamaCare has been declared unconstitutional and the only thing Obama can do at this point is appeal it. And if chooses not to respect the court’s decision from today and continues to implement the law, Levin says the litigants should go right back in front of the Judge and file a contempt order: (Audio at Link)

I realize that talk show hosts have to fill airtime, and comments like this really help to sell commercial spots, but as an exploration of civil law practice, it's all a bit ridiculous.
Any 1L student, and certainly Mark Levin, knows that FRCP Rule 62(a) provides for an automatic 14-day stay. If plaintiffs made their way back to court today, they'd be told to go home.
The government will file notice of appeal sometime later this week, and the 5th Circuit will SURELY grant a stay pending appeal. This isn't complicated. It's unlikely anything will halt implementation (anything from the Judiciary) until such a time that Scotus issues their opinion, my guess is 2012 at the earliest, and probably 2013 more likely.

Good and just have the Army disobey him just like in Egypt. DADT has pretty much alienated much of the rank and file military from the leadership.

Seems like one can get a judge to say almost anything. Bet they find one to say that they can coninue with implementation until appeal process is completed.

A republican appointed judge made it not real or effective in stopping ObamaCare. Now the WH response is the SAME.Valerie Jarrett said, ‘you win some you lose some big deal The SCOTUS will rule for ObamaCare....it is a republican judge’ blah blah blah spin....
Which is why we should be writing our congresscritters asking them what they plan to do about a run-away administration that does not obey the law. Will they draft articles of impeachment? Or will they go along with violating the ruling and the Constitution.
