82-Year-Old Homeowner Who Shot At Men Stealing Trailer Sentenced
The Denver Channel ^ | 9/24/10 | Dayle Cedars

An 82-year-old Wheat Ridge homeowner who was charged after police said he shot at two men stealing a trailer from his property, was sentenced Friday.

Robert Wallace was given two years of unsupervised probation and he can't own a gun.

Wallace agreed to a plea agreement in which charges were reduced to criminal attempted manslaughter and illegal discharge of a firearm, instead of the initial four charges of attempted first-degree murder.

"No one won," said Wallace as he left the courtroom.

Wallace agreed to let the state destroy the gun that was used in the shooting. Other guns he owns will be sold with the money possibly going to pay his legal fees.

Jefferson County District Attorney Scott Storey said, "It is illegal to shoot someone who is stealing your property."

Storey had taken heat from the community following the initial charges of attempted first-degree murder as information concerning the two suspects immigration status surfaced.

"Immigration status did not play a role in this decision," said Storey.

Storey said Wallace "was not overcharged" with the initial charges of attempted first-degree murder. He said charges are based on the law.

Storey said a disposition was reached before public outrage on this case.

One of the suspects, 28-year-old Alvaro Cardona-De Lorea, was shot through the eye, leaving him with brain damage and a disfigured skull. Cardona has undergone a competency evaluation which showed he may not be competent to stand trial. His case has been continued.

The second theft suspect, Damacio Torres-Ochoa, 32, was arrested by federal immigrant authorities at his Boulder workplace on an immigration violation, authorities said. Torres is charged with theft of an at-risk adult. His next court appearance is Oct. 4.

His mistake was not killing them.

Not for lack of trying:

“It ain’t illegal in Texas, brother.”

Amen.

Chased a couple two-legged varmits off my brother’s property north of Dallas a few nights ago. If they’d have turned on me, I’d have made the news. But not been in ANY legal trouble.

“It ain't illegal in Texas, brother.”

I wouldn't roll the dice in Austin or El Paso.

And we don’t care if they’re *illegal* or not.

I say let them go and ship them down here to Houston. I have a trailer on my property and plenty of ammo. I need some practice to re-qualify for my CHL.

Exactly. The court gave him the death penalty — now it’s just for some illegal to carry it out.

This is where my Dad drives me nuts. He harps on carrying a small, easily concealed gun. I harp on carrying "enough" gun.

A .22 or a .380 will work, but not as well as my 10mm does.

Sounds like shot placement wasn't an issue here. Insufficient hydrostatic shock was...

Unarmed? Who said he had to be unarmed? He just can't reload as quickly.

Not for lack of trying:

That's because he was using birdshot.

A rifled slug would have done the job right.

ZEggsackley! There are pistol sized ones that send a deadly bolt at terminal speed ... but with the scum in Colorado the weapon would get called a gun by the DA and this poor guy woul dbe raw meat for the libersal scum running the state and courts.

What I don’t like is he can’t own a gun.
Legally no, but at 82 y/o I hope he protects himself first and worries about "the law" later.
What are they going to do - give him a life sentence?

The guy fired at the thieves as they were pulling away on a city street. He was in the wrong.

However, no way he merited attempted murder charges. I think the outcome is fair enough...what he did violated the law where he lives, and this isn’t a huge punishment.

People forget that theft of property = theft of one’s time.

When you steal someone’s property, you literally have stolen a part of their life. They cannot recover the lost time it took them to obtain said property. That law-abiding citizens should have to sit back and allow punks to steal parts of their life away is horribly unjust and too soft on crime.
