unlawful posession of illegal fireworks

My girl friend need helps. But I don't know how to help her. her brother (35 yo) got a ticket for "unlawful posession of illegal fireworks" on Jul 4. he went to the court , the judge told him to get a lawyer (his income is a little bit too high to get a public defender). it costs $2000 for lawyer. it's rediculous to spend $2000 for having fun with fireworks on Jul 4. the lawyer said, he can pledge on his own at court, but if what ever he says do not make sense, he will go jail for 90 days plus a big fine. it's the first time he got a silly ticket like that . I would appreciate if any one could give me an idea.

He should claim they were undocumented fireworks, not illegal.

He should set some off in the court room to show the judge that they're really fun! What could possibly go wrong?

I hope the court BUSTS this jerk. we have plenty on holidays who play with firworks, and people get seriously hurt.

Things are a little different in Philly than place like Arizona. We had our first rain in 4 months yesterday in Tucson, not good having people who don’t no better shooting off fireworks. Heck the pros we hire for the city display manage to light the mountain on fire every Independence Day, luckily the FD is used to it and keeps truck near by.

My next-door neighbor was shooting off commercial-quality airbursts for at least an hour. He probably spent a month’s house-payment on them! They’re illegal in NC without a license, but you can buy them in SC, only a half hour away. It was a great show. 40 or 50 of us were sitting on sitting on the sidewalk watching ... and he wasn’t the only one with a major production.

Somebody came by looking grumpy, but if he called the Sheriff (no town law, here) he got a brush-off.

We’d all have kicked in for Randy’s fine, if one was assessed!

We used to have a local police department that would never hassle anyone about fireworks. Now we rely on the county and have no clue how they’ll react to the big time commercial stuff

I love the 4th, a neighbor up the street shoots his Thompson, the neighbors do target prat ice off of their porches, across the street I don't have room, fire crackers are legal, God Is Good in the Semi-free State of NH.

I believe that’s called arson, and it is a felony. Here in Texas, fireworks are illegal in Harris County, but not adjacent counties - I guess dry weather is localized - EVERY YEAR, since the law has nothing to do with the conditions.

What state are you in?

If this guy just had consumer fireworks (you say only firecrackers but are dodgy on the source of them) there is no reason anyone should be going to jail. Fines, yes. But jail for consumer firecrackers, no.

By federal law, consumer fireworks are called 1.4G. There are strict limits on the size and amount of pyrotechnic material. (The pros who do the big city shows use bigger shells and are classified as 1.3) They are sold in places like Phantom Fireworks or Sky King. States act insulted when their residents import them illegally from other states, but often enjoy the tax revenue from doing the same for citizens of other states.

It’s a hypocritical racket. Stores in PA (where I am) will not sell to PA residents, but will to outsiders. People from western PA go to Ohio. New York and New Jersey complain about PA’s stores.

But each state makes money off of the trade and it the use of fireworks is tolerated outside of urban areas in the time around the 4th.

If something goes wrong and a person or property is damaged, then there are plenty of laws to enforce. But it really a “no harm, no foul” type of policing situation in most areas around here.

Now, if this guy had some explosives that were not consumer fireworks (1.4G) and were illegal in the sense of being too powerful (the consumer limit is 75 mg of explosive), then you’re talking about bombs. That’s why he needs a lawyer.

When I was younger I would go to Ohio, buy consumer fireworks and set them off. But it was all legitimate, regulated consumer fireworks. I accepted the risk. I was not buying home-made M-80s.

I like color, not just a loud bang.

A straight up answer to your question: NEVER go to court in any kind of criminal trial without a lawyer. What gets done by the Judge can never (for all practical purposes) be undone.

Price shop some, but $2000 sounds like the going rate these days.

Good point. I may have over reacted..uh, yeah, my post was harsh.

I also hate firworks in the neighborhood, I just get nervous that some house will go up in flames, or a kid gets hurt or in our area a brush fire starts.
Usually if the law is NO fireworks, there is a reason for it.
