unlawful posession of illegal fireworks

My girl friend need helps. But I don't know how to help her. her brother (35 yo) got a ticket for "unlawful posession of illegal fireworks" on Jul 4. he went to the court , the judge told him to get a lawyer (his income is a little bit too high to get a public defender). it costs $2000 for lawyer. it's rediculous to spend $2000 for having fun with fireworks on Jul 4. the lawyer said, he can pledge on his own at court, but if what ever he says do not make sense, he will go jail for 90 days plus a big fine. it's the first time he got a silly ticket like that . I would appreciate if any one could give me an idea.

things would be so easy if he can pay the fine. he may go jail for 90 days plus fine. not only fine !

I’m amazed they even enforced that law. It’s illegal where I live and they were setting them off by the hundreds in my neighborhood (and no little ones, either, big mothers) and the cops did zip.

They’ve been illegal in Houston since the early 60’s . . . for that reason.

Might help to say what city & state. I live in a tiny suburb of Oklahoma City. I can get ticketed for having (i.e. possessing) fireworks when people are lighting them off within a hundred feet of my house, and are perfectly legal in doing so.

..twenty seven eight-by-ten color glossy pictures with the circles and arrows and a paragraph on the back of each one explaining what each one was to be used as evidence against us.

I guess he didn’t care what anyone else thought when he shot the 10ft of illegal firecrackers. Maybe they are illegal for a reason...like in the city limits, etc.?

I know we have a law of no fireworks inside the city limits. It’s because of fire hazard with such a dry summer so far. It didn’t stop some people though no matter how many fires they started and left for other people to put out.

The houses are so close it could have burned down several if others hadn’t put out those fires in time. There are laws for a reason.

The man is 35 years old then it's time for him to grow up. If this was a 10 year old kid, then he might deserve some sympathy . . . a 35 year old man deserves what he is facing.

Got to be more to this, people don’t go to jail for three months for firecrackers.Was he selling them???What town and state did this happen. BTW, He can always tell the judge he wants to represent himself and then just plead gulty and pay the fine.

Plead Not Guilty.
Talk to the Prosecutor. Offer to pay a fine and plead guilty for a stay of adjudication.
