Has 'standing' been created in hunt for Obama birth doc ?
WND ^ | July 08, 2010 | Bob Unruh

A decision by Judges Dolores Sloviter, Maryanne Trump Barry and Thomas Hardiman of the 3rd U.S. Circuit Court of Appeals may have opened the door to questions on the record about President Obama's birth documentation and eligibility to be president, according to an attorney in the case.

The judges' opinion recently dismissed as "frivolous" an appeal of a lower court decision throwing out questions about whether the British Nationality Act of 1948 made Obama, at his birth to an American mother and Kenyan father, a subject of the British crown, thus possibly making him ineligible under the Constitution's requirement that a president be a "natural born citizen."

The case filed was against Obama, Congress and others, just before Obama was sworn into office, arguing that Obama was a British subject and not a U.S. citizen.

"We further contend that Obama has failed to even conclusively prove that he is at least a 'citizen of the United States' under the Fourteenth Amendment as he claims by conclusively proving that he was born in Hawaii," the lawsuit claimed.

Attorney Mario Apuzzo represented Charles F. Kerchner Jr., Lowell T. Patterson, Darrell James Lenormand and Donald H. Nelson Jr.

Having your appeal thrown out as ‘frivolous’ is considered a win?

It’s all about the judge keeping her family healthy. What else could she do?

I think he is probably qualified to be President, at least from the citizenship perspective. But there is something on that original that he does not want the world to see. Maybe it lists the father as “Unknown” Maybe the guy from Kenya wasn’t his father at all. Whatever it is, he is not comfortable with it. Soldier on, Birthers! Let’s get to the bottom of it!

I think I want to know the facts before deciding. Producing a birth certificate would very simply end the entire controversy. I don't see the big deal, just FRIGGIN PRODUCE!

Well then he has submitted a fraudulent document. If it doesn’t square with his life narrative and that FAKE COLB he is guilty of well... A Lot of Felonies.

I'm thinking he is older than he says, and so wouldn't be a eligible if he was born before Hawaii became a state.

I love this part... "The issue of the president's citizenship was raised, vetted, blogged, texted, twittered, and otherwise massaged by America's vigilant citizenry during Mr. Obama's two-year campaign for the presidency, but this plaintiff wants it resolved by a court," Robertson wrote.

VIGILANT CITIZENRY I TELL YOU!!! The CITIZENRY was so VIGILANT that not one of them to this day can show you the document that provides the hospital Barry was born in!! Robertson is just one of the condescending schmucks in this whole situation. A judge with his whole defense of Barry built on HEARSAY! What has our nation come to?

A lower court dismissed the action, claiming the plaintiffs lack "standing" to make a claim about an alleged violation of the Constitution – meaning they weren't personally "injured" by the act.

BS. Every American has standing and voters have a personal interest. Our vote is an intimate, personal act. In our past, some groups were denied the right to vote. Were they injured by that denial? Of course.

If obama is not eligible, has our right to vote not been denied by fraud? Our vote has been invalidated, our right to vote has been infringed and we have all been personally injured by those who have perverted the process and injured by the results.

Back of the bus, you impudent serf!

I would take exception to this. Nobody is injured by a limited franchise as long as the government itself is limited as in the original intent of the Founders. It's only when you make government into a big lottery where everybody gets a ticket by just "being here" and the winners are picked by you-know-who that disenfranchisement entails injury.

I'm thinking he is older than he says, and so wouldn't be a eligible if he was born before Hawaii became a state.

http://en.wikipedia.org/wiki/Barry_Goldwater

"Goldwater was born on January 1, 1909 in Phoenix, in what was then the Arizona Territory, the son of Baron Goldwater and his wife, Hattie Josephine ("JoJo") Williams. His father's Jewish American family had founded Goldwater's, the largest department store in Phoenix. Goldwater's mother came from an old Yankee family that included the famous theologian, Roger Williams of Rhode Island."

Barry Goldwater was born in Arizona before it became a state. Was he eligible to run for President, and eligible to serve as President if he had won?

Barry Goldwater, unlike BO, had two American citizen parents.

When Hawaii became a state, I believe there was something in the act that granted citizenship to people born there for many years before statehood.

“Soldier on, Birthers!” I agree. I don’t know where Hussein was born but there is something about that birth certificate that he does not want made public. In fact there’s a lot about every record created in his life that he has gone to great lengths to keep under wraps.

....my point was simple, apparently, any foreigner can be pres. Even a Kenyan.

My real choice, given the circumstances, would be to make Netanyahu president.

He understands democracy and western value better than Obama and does not have that black mans chip on the shoulder.
