There is a mechanism whereby the President can make this happen (a treaty) unilaterally and have force of law, no congress required.

Yes, but there is a difference. To end a filibuster, you need 3/5ths of all senators holding office at that time, whether or not they are all present at the time of the vote. So even if only 75 senators were there for the vote, they would still need 60 votes to end the filibuster.

On the other hand, the 2/3rds vote needed to override a veto or approve a treaty is based on the number of senators present and voting. So if only 75 senators were present, 50 votes would be enough to ratify it.

So the question becomes, could the Dems arrange a vote in such a way as to be assured that enough Repubs would be out of town to allow them to ratify it with the votes they have available?

Yep, but I sure hope they push for it and push hard! November would become an electorial bloodbath for them. These commies are gonna go for broke on everything now, quite frankly it’s better for us and the country that they do.

The same thing was said about the original AWB and the current Health Care Bill. Both got done. One thing in politics is certain: Never say NEVER! Know what scares me? What happens if this Congress gets the boot in November and they decide to leave the country with a "gift" to remember them by, so between election day and inauguration day they decide to ratify that treaty AND pass all the other parts of the Obama agenda so that there is nothing left of the country for the new comers to fix.
