I’m gonna go ahead and say it’s not a denial of a “fair trial” or “due process” for a court not to allow every damn thing the defense wants.

Background:
Lt. Col. Terry Lakin is the highest-ranking and first active-duty officer to refuse to obey orders based on President Obama’s eligibility.
A top-ranking, highly decorated officer in the U.S. Army says he’s now refusing all orders until President Barack Obama finally releases his long-form, hospital-generated birth certificate to prove his eligibility to serve as commander in chief.
“I feel I have no choice but the distasteful one of inviting my own court martial,” said Lt. Col. Terry Lakin, an active-duty flight surgeon charged with caring for Army Chief of Staff Gen. George Casey’s pilots and air crew. “The Constitution matters. The truth matters.”
Considering Obama’s eligibility in irrelevant to the charges filed against him then this is not surprising at all.

OK ... I looked the guy up.
This is the guy that refused deployment because he believes Obama is ineligible for the Presidency ... an admirable and gutsy move that has almost no hope of working.
The Court ruled that some evidence of Obama’s eligibility was not germane to the case because Obama’s eligibility does not affect whether military orders from superior officers must be followed by junior officers. In short — the judge ruled that Obama’s eligibility does not affect whether a Lt.Col. must follow the orders of a Colonel ... so the evidence was irrelevant.
This is pretty well how the case was expected to go. Junior officers are not called to judge whether their superiors are eligible to give orders, and are generally not permitted to willfully disobey an order and then demand documents from the Commander-in-Chief (eligible or otherwise) to justify why he should obey a superior.
The guy was always going to be punished for disobeying a superior ... it is the choice he made.

Hey I refuse to pay federal taxes to the IRS until Obozo releases the appropriate forms that all military personnel are required to submit. If a doctor works for the military he must submit his college transcripts, medical school transcripts. a soldier must submit high school transcripts and appropriate birth certificate. college student must report selective service registration number, high school transcripts and financial aid transcript. Why praytell is Obozo any different. What is it color, heritage or what. Affirmative Action does not free a person from the law.
