(CBS) Updated: 6:30 PM, June 1: In an email to MSNBC's Norah O'Donnell, Elizabeth Edwards stated that she is not trying to deny John Edwards custody of their two younger children in the event of her death.
Elizabeth Edwards reportedly doesn't want her estranged husband, former presidential hopeful John Edwards, to raise their kids if she loses her battle with cancer.
But can a mother legally keep an estranged spouse from getting custody in that kind of situation?
The New York Daily News reported that Elizabeth is looking into whether the couple's 28-year-old daughter, Cate, can assume legal guardianship over their two youngest children, Jack and Emma. The newspaper reports that, if she dies from the breast cancer she's fighting, she doesn't want them raised by John.
Elizabeth's sister told the paper: "There a lot of family members who are willing and able" to take care of 10-year-old Jack and Emma, now 12.
Since Elizabeth announced her cancer had returned, John has admitted having an affair with his former campaign videographer, Rielle Hunter. He's also acknowledged he is the father of Hunter's now-2-year-old daughter.

the woman only wants what is best for her children John Edwards is a scum bag. She has breast cancer again and she desires that her interests through her daughter be given to the surviving children. I fully agree that she is seeking out what is best for them and John can go to hell.
If anyone doubted what a scumbag he is, this should seal the deal.

I hopped on this thread hoping to see the “no fat chicks with cancer” graphic with the Silky Pony’s face on it. Guess I’ll check back later.
Elizabeth Edwards announced that the cancer was back, in an "incurable form", over 3 years ago.
Is there any "typical" timeframe for a terminal stage case of breast cancer to run its course? Of course (and without sarcasm), I hope and pray she found a treatment course that gives her a hope for recovery.
Whatever it takes, Michelle, to keep your kids from that psycho adulterer... but I have to ask, why did you marry him in the first place?
Look at the positive side...he won’t have to worry about kids mussing up his $600 haircuts.
She’s obviously jealous that Tipper and Al separating warranted breaking news, when her separation from The Silky Pony only got coverage in a supermarket tabloid.
And I think The Silky Pony isn't going to fight for custody for that very reason. Liz basically took him off the hook with this move.

Very doubtful they were born from Elizabath’s eggs at age 49 and 51, but they may have been donor eggs sprinkled with Silky’s pixie dust...

I think she knows best where the best interests of the kids lie.
I hope she can find a way to beat this cancer. Some docs have found ways to “live with” some cancers for decades as people are not living with HIV without losing quality of life.
I’d hate for the kids to go to Rielle and John.

That’s really cruel. EVERY cancer is different. Every situation is different. It probably just means they know there is no cure, but however long she lives with it is another matter. I have just been through a situation with someone close to me who was diagnosed with Stage IV Colon cancer already in his liver, a pretty dire diagnosis. His surgeon didn’t think he’d make it for a year. But with good treatment and a positive outlook, he made it for four and a half years. She could, too - maybe more.
