ELYRIA — Teen murder suspect Daniel Kovarbasich was a victim of sexual molestation and killed 55-year-old Duane Hurley so it would stop, claimed defense attorney Jack Bradley during opening statements at the 16-year-old’s murder trial.
Kovarbasich, of North Ridgeville, is accused of hitting Hurley in the head with a pickle jar three times and then stabbing him more than 50 times on Jan. 22.
He is being tried as an adult for two counts each of murder and felonious assault in a bench trial before Lorain County Common Pleas Court Judge James Burge.
“The incident on Jan. 22, 2010, is not self-defense. It is involuntary manslaughter and physical evidence indicates the victim was ambushed, pure and simple,” Assistant Lorain County Prosecutor Mike Kinlin told Burge. “I expect defense counsel to claim Duane was trying to rape Daniel, but you’ll see that doesn’t appear to be true … There may have been something sexual going on between (Hurley) and defendant, but there was no rape.”
Bradley said Hurley knew what to look for when he met Kovarbasich in a park three years ago and used his dog as a “lure” to talk to him.
“These people like Duane T. Hurley think they know what they are looking for, they are looking for somebody they can groom,” Bradley said.
“They look for the poor kid, they look for the kid whose family doesn’t have very much and looking for someone he can sort of bring into his world and Danny was that person.”
Then, Bradley said, the sexual jokes started, which quickly turned to watching pornography, leaving the bathroom door open while urinating and touching each other’s genitals. He said Hurley showed Kovarbasich gay and child pornography.
“This predator, Duane T. Hurley, knew that Danny would access his computer and might stumble upon some of this pornography that was illegal and that was young boys around the ages of 13 to 16 engaged in sexual contact,” Bradley said.
“In fact, Duane liked to take pictures of Danny. Not only Danny petting the dog or sitting on the couch, but also Danny sleeping. Because Duane, in his warped world, decided that this was going to be his love interest. That Danny was going to be his boyfriend … This was going to be the guy he was going to groom to be his lover.”
Bradley said Hurley had “some of the nice things that young boys like, especially fast and attractive cars.” He said Hurley used incentives, such as his cars, gifts and money, to con Kovarbasich into sexual favors.
“And this is not just something that happens overnight,” Bradley said.
“This grooming continues and continues and it’s not easy for any kid to admit. It’s not easy to talk to a police officer and say, ‘Yeah, I was engaged in a sexual relationship with Duane T. Hurley.’ So when police talked to him he didn’t tell them anything.”
Bradley said about two weeks before Hurley was found dead in his home, Kovarbasich was sleeping on the couch when Hurley started having sex with him. Bradley said Kovarbasich pretended like he was sleeping.
“Why?” Bradley asked rhetorically. “Because his parents couldn’t afford to do the things Duane T. Hurley could do for him.”
Bradley said the breaking point came for Kovarbasich when Hurley told him in exchange for helping him plan a romantic dinner for Kovarbasich’s girlfriend, he had to have sexual contact with him.
“But you know, you gotta pay me back,” Bradley said Hurley told Kovarbasich.
“And at this point, Danny knew what Duane meant … He takes that pickle jar and smashes it into Duane’s head and he does it because of what Duane has done to him and what Duane intends to do to him again.”
Kinlin said when Hurley was hit, he was in a stupor and could not defend himself.

What the Defense is alleging is pretty much exactly how it’s done. Don’t ask me how I know. You’ll have to trust me on this.

That is what the prosecutor says. The man this teen killed had a history of manipulating young men. He lost his city job on corruption charges for exactly that. This story is clearly not finished.
Mr. Frodo doesn’t need to be groomed.

And their association went back to when the kid was 13. Selective enforcement. Did forensics find the child porn on the murder victim’s computer that defense is alleging?
I guess since the victim was homosexual and the murderer acted out because of an incident springing from his heterosexual relationship with a girl, he’s lucky he isn’t being charged with a hate crime.
In a country where gay pedophiles are treated as exemplary citizens, this young man is going to have a difficult battle. If he was a she, it might have been easier to prove the victim (if you can call the deviant a victim) was a predator.

OMG. That poor kid. Murder wasn't the answer, but I can understand the hate this kid must have had for that monster. If what this kid says is true, and I believe it probably is, the world is a better place without that sick pervert. If this kid didn't stop the freak, who would? He's homosexual. That puts his vile behavior into a protected, "victim" class. The perp would have been back out on the street looking for a new little boy within a week.
Sometimes the "SSS" solution applies to two legged animals as well. These pedophilic monsters will try to work their way through entire families. There's only one way to stop them, especially if they're politically or socially connected.
They'll target a 'broken' family with an absent father and slowly start their 'grooming' process. Once one young male has gotten 'too old' to fascinate their sick desires they'll move to a younger sibling.

If they can create reasonable doubt by arguing self-defense, then at least part of this was legal. Certainly the first three times you hit someone in the head with a pickle jar ought to be okay. Evan a couple stabbings should pass muster. But anything after 40 or 45 stabbings has to be considered excessive. Before that point, he had probably already ended the threat to his own safety.

It just goes to show the anger that was building up in this poor kid. Maybe he couldn't stop himself. He just had to get it all out.
Remember, this kid was horribly abused both physically and mentally, and being trapped into a corner the way he was for so long, lashed out in an uncontrollable rage.
Imagine if YOU were this kid. How would you react toward this animal if you were finally in control of the torture device?
