California's Rapid Enforcement Allied Computer Team entered editor Jason Chen's home without him present, seizing four computers and two servers.
They did so using a warrant by Judge of Superior Court of San Mateo. According to Gaby Darbyshire, COO of Gawker Media LLC, the search warrant to remove these computers was invalid under section 1524(g) of the California Penal Code.

Apple has not brought these charges. Apple was just requesting their prototype back. The DA and the police are acting on their own, as the are required to.

If proving your point is that the police get warrants for probable cause to investigate a crime (with particular equipment that may be involved) and that judges signed warrants for the police to investigate crimes that they have probable cause for -- I'm glad I'm proving your point -- because that's my point too ... LOL ...
Of course, everything one does is illegal. Persons cannot live one day without breaking several laws.

What crime was committed?
I believe Kalifornia also has a law still on the books that makes it a crime not to boil your dust rag after using it. The way people are saying Giz committed a crime have yet to say if the act is a real crime or just another stupid law passed by stupid politicians.

Steve Hitler Jobs used his considerable political clout and influence to get the cops to be his stooges. Jobs is a thug. Closed, secretive, and throws temper tantrums when things dont go his way. Apple is everything they accuse Microsoft of being. Apple treats its most loyal fans and customers with contempt.

Ummmm.., no..., there was a legal requirement for him to return it, when asked to return it. And he did. That wasn't the problem, though.

I am not seeing the crime here. I daresay this little slip was insulting to Apple, and rather than take their lumps at the human error, they chose to see what they could do for revenge. Rather thuggish. Do not tell me there was no pressure on the cops / DA from someone at Apple. Riiight.
