This was theft by conversion (or worse). There were no “free speech” issues here. I have a feeling the investigation will discover this was more than a case of a drunk Apple employee forgetting the iPhone in a bar.

When lost property is found, it is the responsibility of the finder to return it. Not doing so can be considered stealing. Instead this "finder" sold it (for a sizable reward) to Gizmondo who, realizing its value and public interest, opened it up, scrutinized and published the pictures for its own profit, before returning it to the owner.
