Why won't my landlord cash my rent check? (vanity)

I don't want to be some sort of conspiracy nut, but I paid my rent on 2/29/10. To this day, my landlord has not deposited this check. I will owe another check and pay it today.

I've mentioned it to him (three times now) and he says he has to ask "the boss" which is his wife. I can't figure it out; my landlord is an electrician who has not been on a paying gig since May of last year since construction here in S. Utah is nonexistent right now.

Last week when I had to call him on a minor matter, I got his answering machine. He told me later that his phone had been temporarily off, but was now working.

I'm a nervous wreck. (and back to bed)

But your thoughts would be welcome.

Ask them to give your original back and you will write them a new one. I bet they can’t do it because they misplace or lost your original check. I assume if you have to cancel your original check with your bank you will charge you a fee. Make an agremment with them that a new check to replace the old check would be minus the bank charge for the lost check!

Good point. Maybe the check date gummed up the software and it doesn’t exist except in some alternate universe now.

Pay with cash or a postal money order if possible going forward and make sure you have a receipt every time you pay.

One of the most common landlord scams is to not cash a check and claim non-payment to provide grounds for eviction.

Your case won’t be helped by the fact that there was no February 29 this year. He may intend to use that fact to argue your check was “invalid” and sock you with late fees.

Feb-10 28 days!

Since wrote the check on Feb 29th maybe you left it in the DeLorean and didn't mail it in this time zone!

If you don’t want to pay him in cash then send the rent in a certified letter that must be signed upon receipt.

You should have known he is a Freeper , now he will raise the rent and tell you he never got the deposit check . The new rent deposit is first and last and a like amount security deposit .

I made a typo. Just checked my checkbook again; check was written on 2/28. *sheesh*

They have no reason to evict me. I pay EARLIER than anyone else. When they’ve been short of money, I’ve paid my rent as much as 3 weeks early, out of the goodness of my heart. There have been months that I was the only renter they’ve had, and my rent check went to pay for their grocery bill.

Trust me, this is a puzzle.

Some of these assessments I’ve read as replies are excellent. I would just make sure you STILL have those funds available in your account, including the funds to cover the current check you are now giving him for next month (April).
“I have to ask the boss” is a mystery to me.
But yeah, he may be overdrawn on the usual account he deposits checks into, and his wife may be the final arbiter
on whether they should leave their current bank , with a negative balance,go ahead and deposit it in the current bank to wipe out the negative balance, in whole or in part, or take their chances and open another account at a new bank with your (good) check, which would give them the full amount of your check. STILL, a month seems a long time for them or her to decide a question like this.
The idea would be to leave their original bank in the lurch just for the sake of not having your big check eaten up by their overdraft amount. Your check would presumably pay off their overdraft amount , fully or partially, but would still leave them with not as much as they’d have if they deposited it in a new bank. I am sure this happens a lot, and am surprised banks don’t seem to have an old-boy network to warn each other of stuff like this. But instead they’re always trolling for new customers, regardless of their past history.

You know what?

That makes the most sense to me. Phone cut off. That could mean his bank is biting him in the ass stacking overdraft fees.

I may call him tomorrow and bring it up, offering to pay my rent in cash, provided he writes me a receipt.

Sounds like he might want it in the next quarter...

If you haven't got a notice by now to pay up...I wouldn't worry...but send him something by certified mail.

Because we have a super sophisticated system of rent payment here (that has worked since October ‘06 btw)

I shove my rent check under his mom’s door. She lives behind me. She gets the check to him. There are only 5 units. So no, I’ve never had a rent receipt.
