Maybe there's more to this story but as written, this sounds like a miscarriage of justice. As written it sounds like someone broke in Brill's home to rob him, he fought back and now the real criminal is being treated like a victim while the victim is being treated like a criminal.
I wonder what the party affiliation of the Cortland County District Attorney is?

Yeah, the story is pretty sparse on facts. I’d guess a miscarriage of justice, or he beat the guy past the point of reasonableness. The guy’s unconscious and Brill kept beating him with a brick.
Personally, I believe that if you break into someone’s house, whatever happens to you is tough shitski for you.

Someone breaks in my house, I’m not messing with him.
Because that means he hopped an electric barbed wire fence, walked through a field of grumpy bulls, got past two dogs that can hear a pin drop a mile away, noticed a homemade shooting range but kept walking anyway, and got in my house before I had a chance to grab any assortment of handguns, rifles or shotguns that are 10 feet away from my bed.
He’s either a ninja or just plain crazy.
