It's not hard to imagine us getting involved in some mythical place, call it Iran for the hell of it, and having some pilots captured after delivering munitions on a target. This trial makes it easy to try & hang them as civilians instead of holding them as POWs - declarations of war were issued, big shots planned strikes on targets, civilians died, some of the soldiers got captured. We've already extended geneva convention privalegs to these "soldiers" even though they don't deserve them, but do u think our soldiers in the future would be better off tried as civilians for murder or treated as POWs? Am I way off base here?
The biggest risk is that the Obama administration will turn the trials into a war crimes tribunal against Bush and Cheney.
And just wait until they wheel the now paralyzed Fort Hood jihadist into a courtroom...
No. We haven't. That would have been the best thing. We could have treated them as spies, mercs, etc. No set uniform and shot and killed on the spot. There is no Geneva protections for spies, etc.
Obama’s presidency would be utterly destroyed were this trial to result in anything but life imprisonment for these peeps (and even life imprisonment instead of the death penalty would be seen as lenient by many voters). Which means he ain’t going to let it happen, unless he suddenly turns into a giant idiot.
The jury is always out on that for me. I vacillate back and forth between complete incompetent, idiot and pure ideologue on a mission.
The worst possible outcome is that these devils are acquitted and WALK.
If that happens, half of New York will storm the place they’re being held and take their own vengeance out on them. Even the US Marshals wouldn’t be able to stop them without shooting a whole lot of angry civilians.
They MUST convict, and the sentence MUST be death. Anything less is unacceptable.
He’s neither, his mission is himself and his own power. He’s already demonstrated that he’ll compromise on his views if it’s politically expedient. During the campaign he went from borderline-Leninist to post-94 Clinton moderate, depending on whether he was going for the nomination or the Presidency. Remember when he backtracked on domestic oil drilling and domestic eavesdropping, and all of his supporters very briefly turned on him? Remember in 2004 when he said “my position on Iraq is basically the same as George Bush’s?” Yeah, his preference is for socialism, but ahead of that preference is his own preference for power.
Khalid Sheikh Mohammed is going to do it for them. And it isn't just a risk. It's guaranteed, which is why Eric Holder and Barack Obama chose this course of action. KSM will probably even serve as his own lawyer because his ego really is that enormous, and going pro se will give him more time on camera. And New York is the headquarters of the American news media, which will be happy to help.
Make no mistake. This will be a trial by proxy for Bush, Cheney, Rove, Rumsfeld and Alberto Gonzalez. Obama's sycophants in the press will help KSM make sure of it.
He'll have a small army of ACLU lawyers at the taxpayer's expense, uncovering classified documents for him through the discovery process. He'll find a way to get them to his friends at al-Qaida. When we tried a terrorist in New York for the first World Trade Center bombing (the bombing occurred in 1993), classified documents obtained by the defense through the discovery process did indeed end up in the hands of al-Qaida.
There are so many things that could go wrong here for America. But Obama and Holder are convinced that if the American people are constantly reminded about waterboarding and Abu Ghraib, it will translate into fewer Democratic congressional seats lost in the 2010 and 2012 elections, and re-election for Obama in 2012.
In case any left-wingers claim that a civilian trial is the only way to ensure that justice is served, Eric Holder announced in the same press conference that while KSM and four other terrorists will be tried in civilian court, a second group of terrorists (most notably the suspected mastermind of the USS Cole bombing) will be tried in the military tribunal that I believe should be used for both groups.
Obama and Holder don't care about justice. They don't care about national security. They only care about winning elections.
Ping. See previous post.
The average American is actually a conservative, and also loves his country, and hates her enemies.
Let no one be mislead; members of Al Qaeda, radical and fundamentalist Muslims, and terrorists are seen as not only enemies of America, but of Americans. The average Joe knows that the enemy doesn't care that we are Republicans or democrats, but that they want to kill us all.
The average American will be outraged by this. They'll want to know why our government—their own government—is giving these scum a platform. They couldn't care less about Bush or Cheney. I doubt KSM will be able to hid his hatred for Americans and infidels and solely keep his rants to Bush and company.
The town hall outrage will be a slender reed compared to this.
I vote EPIC FAIL.
Why?
We have people in this country who are responsible for a million human deaths a YEAR and no legal hand can TOUCH THEM!
do u think our soldiers in the future would be better off tried as civilians for murder or treated as POWs?
The premise is a holdover from the sixties, where our soldiers in Vietnam were labeled war criminals by everyone opposed to the war. It wasn’t a “real” war and so they all needed to be tried by a jury of their peers until found guilty.
Obama and Holder don’t care about justice. They don’t care about national security.
Just kick that terrorism can down the street so to speak.
However, there are several legal disasters that ARE real in this change. See the second link, below.
Congressman Billybob
KSM is ultra-popcorn. Unpredictable, and street smarter than Holder, Obama and the ACLU by a few light years. If I was in proximity to him I’d kill him first thing, before my next breath, that’s how deadly dangerous he is.
I’m absolutely sure he’s played them for suckers.
I will stick with “Barak Obama is a kamikaze President aimed at the heart of this Republic.”
Kamikaze’s don’t need to be particularly competent, just dedicated.
The trials turn into a circus, tons of sensitive intelligence gets released, and the terrorists end up walking.
Um, since this scam is about diverting the nation’s attention away from cap and tax, obamacare, and union control of a huge segment of your life, elections are not the primary concern for the thuggery now murdering the ‘we the people’ Republic.
I will weigh in on this. It is important to first realize the overriding Obama goal: the destruction of this nation.
He doesn’t care about supporting his party, demonstrating American justice, stopping terrorists, even whether he gets re-elected. All of these things are simply side effects of whatever action he takes, which is ALWAYS the worst one for the country. ALWAYS.
So, the worst case scenario in the case of the New York terror trials is a multiple benefit for him:
Framing Bush and Cheney as arch-villains
Drawing terrorists into New York for hostage-taking and attacks
Decimating our intelligence on al Quaeda by revelaing such information during the trial.
Destroying foreign agencie’s intelligence on AQ, and thereby destroying allies’ confidence in our nation.
Promoting Islam and terrorism through the speeches KSM and others will make during the trial.
Undermining our justice system by making people lose confidence in its effectiveness.
Destroying the military through attacks on Gitmo guards, military intelligence, rules of engagement, etc. to the point that the military is hamstrung.
Probably all of these items will be issues during the trials. And the end result will be a population demoralized and a nation’s defense devastated. And THAT is the result Obama wants.
