Orly Taitz asks Land to recuse himself

Attorney Orly Taitz, the “birther” lawyer under threat of sanctions by U.S. District Court Judge Clay Land for filing a “frivolous” lawsuit, filed a motion Friday asking the judge to recuse himself because of personal contacts and financial stakes he may have with President Barack Obama’s administration.

Land was appointed to the bench by President George W. Bush.

Taitz represented Army Capt. Connie Rhodes when she filed a Sept. 4 complaint arguing Rhodes shouldn’t be deployed to Iraq because Obama couldn’t legitimately hold office. Land not only ruled against Rhodes, but ordered Taitz to explain why he should not fine her $10,000 for filing a “frivolous” lawsuit.

On Friday, Taitz asked for an extension to respond to that order, but also asked that Land recuse himself from the case. In her motion for recusal, Taitz:

* States Land may have improperly been in contact with U.S. Attorney General Eric Holder.

* States that Land’s ownership of stock in Microsoft and Comcast could give the judge a financial stake in the outcome.

* Likens her plight to that of the late civil rights icon Thurgood Marshall in the 1940s and ’50s.

“The primary reason for the undersigned counsel to file this motion to recuse, however, is that Judge Clay D. Land has by his own actions created a constitutionally intolerable situation in which he is both complaining party, prosecuting attorney, judge and jury regarding the charges of frivolous filing and sanctionable conduct which he has leveled ...” Taitz states.

As one of those long-standing freepers, I'll answer this. It's not a psychological aversion, except maybe an aversion to falsehoods. You seem to think it's a matter of what one *wants to be* rather than *what is*. You're wrong. It doesn't matter of one hates Obama or loves him. Whether he is eligible is a question of fact.

If fact is true one shouldn't say it is false or vice versa, no matter where one falls politically. That's the number one mistake the Birthers are making. They think their facts must be true because they want to be rid of Obama.

Those of us who dispute the Birthers and criticize Orly, do so because we believe they are wrong about the facts. It's no deeper than that.

I have trouble understanding how any rational person can believe that someone like Soetoro/Obama who spends $millions suppressing his birth and school records isn’t hiding something very material. The first principal of winning legal disputes is if the truth is in your favor make it public quickly and repeatedly. Even if the truth is embarrassing but not legally damning you make it public and get past it.

That’s why I search for psychological explanations for those conservatives who pretend to believe that the facts are actually in Obama’s favor. You folks make me rub my eyes and shake my head in amazement.

Orlie Taitz is licensed to practice dentistry and law in the State of California, which is more than I personally have achieved. Last I checked she owns the dental practice, and has a number of other dentists working for her.

It’s ridiculous to expect perfection from anyone in any difficult field of endeavor. Did you know that Reggie Jackson struck out 2,597 times, and he still was enshrined in the Baseball Hall of Fame with a 93.6% vote on the first ballot?

If he is proved to be an ineligible fraud, and those who could do something about it don’t due to fear of consequences, our republic is over at that point.

From then on, any schmuck from anywhere can freely lie, bribe, thug, and violate his way into the office of the President. That would be the precedent.

If Reggie Jackson struck out 2,597 times in 2,597 at bats then he'd be a laughing stock. Orly hasn't lost 2,600 birther cases, but she has lost every one she's filed.

He can hide all kinds of things without it making him ineligible for the office. Remember, the issue is legal eligibility, not his character.

Also, he hasn't spent millions to hide things. He's spent whatever to pay lawyers to write filings in lawsuits he didn't originate. They've done exactly what they should be expected to do in the circumstances.

Or another way of saying it is that the other 73.7% of the time or 7,267 at bats he didn’t strike out.

Now Orly has yet to get out of the batters box other than a strikeout. I’d love to see her get to first base, hit a home run or maybe just a sacrifice bunt.

And if she wins just one case, her name will belong with Washington’s when great Americans are spoken of. Will you be disappointed? Or possibly happy that your country has been saved from the communist imposter?

Looking at her dental website, I’d guess she’s put a $200,000+ per year career on hold, to say nothing of interrupting her family life with her husband and three sons, just to try to save America from Obama. And all the gratitude she gets for her patriotic service is some of her fellow conservatives call her a “nut”. That’s Obama’s job, folks; you don’t need to do his dirty work for him.

Some of us absurd crazy traditionalists believe that Barry whateverhisnameis has to show he is eligible to serve as POTUS. And so far he has not done so. We’ll find out tomorrow what Judge David Carter thinks.

And that's one reason why some people do call you crazy. You think you can make up rules as you go. BTW, that doesn't make you a traditionalist.

Obama IS president. That's the status quo. He doesn't have to prove anything else in order to get the job he already has. Birthers want to overturn the status quo. To do that, or to have a hope of doing that, they need to prove a valid case.

“if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified” 20th Amendment, US Constitution.

Obama indisputably became President-elect when Congress tallied the electoral votes. So far he hasn’t seemed to qualify for the office, so it’s anyone’s guess if he is legally the President, or just an imposter. Will as some surmise all of his actions be retroactively disqualified? The courts need to rule on the law and the facts, since the constitution is unclear on the correct procedure for proving qualification for office. They may in fact rule that qualification is a political matter, and anyone is qualified who is acceptable to Congress. Or they may take a different viewpoint, and assert that qualification is a legal matter which can be adjudicated by the courts. If Judge Carter is brave enough to hear the case, we may find out in a few months.

It would be great if some high-powered competent legal team unseated Obama.

I seriously doubt it will be Taitz.

Obama could do worse than to have hired her to put a clown's face on the whole issue.
