Because iPod Touch owners are not getting their updates on a subscription basis as iPhone users do, according to the Generally Accepted Accounting Principles (GAAP), they have to pay for each update that adds functionality. iPhone/iPod touch 3.1 adds several new functions to the iPod touch.
That is what AT&T is claiming, and why tethering + MMS has been delayed. While many phones available today can do web, and most smartphones can do a lot more, the iPhone has so many apps that draw from the ‘net, as well as push-enabled apps - I can imagine they use significant bandwidth as compared to more basic devices.
Then again, AT&T has also been pushing their laptop wireless cards pretty heavy for the last several months - and I can imagine that would represent a pretty good chunk of bandwidth as well.
That being said, I don’t know if I am going to do the 3.1 update just yet. I still use tethering every so often and don’t really want to lose that until AT&T decides to get their heads out of their rectums...
And why would I want to pay $4.95 for a .1 upgrade anyway?

I decided to download 3.1 after some review of the improvements. I was just surprised that it was only a few months ago that I upgraded to 3.0 and would have thought that the .1 would be a free one. Ah well, I’m so happy with the iPod Touch, and the new Snow Leopard on my MacBook Pro, that I’ll do whatever they tell me!

It was a problem at the Capitol. But then again with a million or so people in such a concentrated area, all texting and using the data network at the same time, understandable.
But otherwise, no real problems. The only gripe I have is 3G isn't everywhere. On the drive to DC, between cities, it's the Edge network. Edge is okay (not great) for pure text, but if you're trying to update the cache on the google map app, it can be slow.
The iPhone is my only Mac, I run Linux on my laptop. iTunes doesn't support W2K, only XP or later. I have W2K set up in VirtualBox, but since I needed XP or better, I downloaded Windows 7RC1 and set it up in VirtualBox. Works great in there, and iTunes installs and syncs the phone just fine.
The problem arises with the iPhone OS upgrade. I've bricked my phone twice. From the 3.0 to 3.01 upgrade, and then again from 3.01 to 3.1. I somehow managed to get 3.01 installed, but I had to reset the phone to factory before it would upgrade, and even then it was a bit of a kludge as to how I did it.
This time, same thing. but I got farther in understanding what was going on. When doing the upgrade, and iTunes is prepping the phone it resets, and VirtualBox loses its USB capture. Doiing some digging, I discovered that somehow, the USB identifier data changes slightly, and therefore VirtualBox does not recapture the device. iTunes freaks out and the phone is left a brick, with a factory reset the only option. The suggested remedy was to plugg the phone back into the USB and add a new USB filter for the iPhone.
This seemed to work. So now that I have both filters defined, I'm hoping it won't be a problem with the next upgrade.
Probably a VB issue, but might be that W7 is a release candidate, and therefore not fully supported, or the iPhone driver is not up to snuff, I don't know. Just thought I'd offer this warning for those running a similar setup.

I think this also disables the free ride on tethering as well, which means iphone users will have to wait even longer for ATT to get off their butt.
I want one, but I am thinking I may wait for it to come on Verizon unless I just can’t stand it and decide to jailbreak the iphone and use it on Tmobile or even ATT if necessary.
You can still do tethering via jailbroken phones I believe, but it does break the legal tethering.
Just bought a surplus demo 24" computer at the Apple Store ~ when I looked at the pre-programmed FAVORITES I found it had NPR, GOOGLE, CNN, MSNBC, and all that sort of stuff.
Took a few minutes and a bunch of deletes and now my FAVORITES say www.DRUDGEREPORT.com and www.FREEREPUBLIC.com
I feel much better.
Now, to figure out how to hook up the spouse's I-phone. There's a wire that just plugs right in and you can use your computer instead of that little hard to read pocket calculator thing.
