A lawsuit filed on behalf of Ambassador Alan Keyes, a candidate for president on California's general election ballot last year, challenging President Obama's eligibility to hold office under the requirements of the U.S. Constitution will be appealed.

Judge Michael P. Kenny said the secretary of state, who is responsible for election laws in the state, has no "duty" to demand proof of eligibility from candidates.

But now Gary Kreep of the United States Justice Foundation has confirmed to WND the case will be appealed.

Gary Kreep—now there’s a blast from the past! He was active in Young Americans for Freedom in California back in the “70’s and ‘80’s.

Someone has to have the authority or duty to obtain proof. Otherwise the Constitutional requirement is worthless.

Indeed. IMO, that would be the very same people that empower (elect) them. That is, ‘we the people.’ However, as we have seen, there is much judicial activism taking place (re: nobody has standing b.s.).
