Judge Michael P. Kenny said the secretary of state, who is responsible for election laws in the state, has no "duty" to demand proof of eligibility from candidates.

Someone has to have the authority or duty to obtain proof. Otherwise the Constitutional requirement is worthless.

Indeed. IMO, that would be the very same people that empower (elect) them. That is, ‘we the people.’ However, as we have seen, there is much judicial activism taking place (re: nobody has standing b.s.).
