If this had been in Austin, the old guy would likely have charges...but this was in Conroe...and I’m thinking he is pretty safe. Although some relative could put up civil court proceedings claiming unnecessary actions. What they don’t say is how many shots were fired....and I’m thinking if it was just one...the old guy was a pretty good shot.
Boudreaux again pushed the older man and allegedly struck him in the chest area where he recently had a pacemaker inserted, police said.

Boudreaux and his wife (Berwicks granddaughter) were in the process of getting a divorce, Berry said. The preliminary investigation indicated the younger man went to the elderly mans residence where he attempted to take his two small children, a female toddler and a slightly older male, he said. The children and their mother have lived there for approximately five months and she and Boudreaux were in the process of divorcing, Berry said.
Berry said there were prior calls for service at the residence, but did not elaborate on the nature of the calls.

I didn't find the story at the link, but you know the back story is a battle over custody and visitation.
Grandpa followed him around, so self defense isn’t much of a defense here, is it?
I wonder why the mother didn’t have them, but placed them with an 80 yo couple?, wow, the kids must have worn them out.
I wonder if this is a case of the mother hiding them to punish the father, and then him finding them and getting killed for trying to see his kids.

It can be anywhere from bad to horrible but it usually does’t end in death. I’m sure more facts will come out about this case. I strongly suspect the soon to be ex-husband was a spouse abuser.

How do we know that the father didn’t have a legal right to be with his children? I’ll wait on this one.
1.)Grandpa didn't follow him around. The guy was there without permission which effectively means, in a lot of states, that he was breaking and entering. He pushed Grandpa out of the way when Grandpa tried to stop him from coming in. Grandpa tried to get him to leave peacefully but daddy wanted to take the children and got physical with grandpa by striking him in the chest. I have a pace maker and if any a**hat hits me in the chest they are also going to be shot.
2.)The mother IS living with granparents. The article clearly states that she has been staying there "with her children for about 5 months" while in a divorce proceeding.
If this guy had a problem with the custody, of if his wife acted unlawfully he should have gone to court. In most states his actions would be considered kidnapping. I know, they are his children also but you don't have the right to go into your ex-wife's residence and forcibly take the kids. Grandpa acted within the law IMO.

Sounds like Brice was a fool. A dead fool now. If he had a legal right for visitation and the family was refusing - he should have had the sheriff’s office send a deputy with him instead of trying to play big shot with an old man who acted in self defense.
